The Appeal Chamber held today, on 20.10.2021, at 10:00, the public hearing of case (JR) 21/2021, dated 29.04.2021, corresponding to the appeal of the Public Commissioner against decision no. 332, dated 12.01.2021, of the Independent Qualification Commission, related to the assessee Lindita Male (Ziguri).

During the submission of the appeal grounds, the Public Commissioner requested further investigation into the asset assessment criterion and additional information and documentation to the purpose of the review of the case, as well as an overall evaluation of the case, which, according to the Public Commissioner, was not complete and thorough by the Independent Qualification Commission decision.

The Public Commissioner requested the Chamber to consider the appeal grounds and to decide alternatively, either uphold or amend decision no. 332, dated 12.01.2021 of the Independent Qualification Commission.

In response to the Public Commissioner’s appeal grounds, the assessee submitted new acts, which she considered exhaustive for the appeal and requested the Panel to accept them as evidence.

The assessee requested the dismissal of the appeal of the Public Commissioner and the upholding of decision no. 332, dated 12.01.2021 of the Independent Qualification Commission.

After consultation, the trial panel decided to open the judicial investigation of the case and to accept as evidence all the acts submitted by the assessee. In order to comment on the further investigation of the case, the trial panel decided to adjourn the hearing until 26.10.2021, at 10:00.

The public hearing shall take place in the premises of the Appeal Chamber, at: Boulevard “Dëshmorët e Kombit”, no.3, Tirana.

Në Kolegjin e Posaçëm të Apelimit është regjistruar çështja (JR) nr. 60/2021, datë 20.10.2021 që i përket ankimit të subjektit të rivlerësimit Durim Hasa kundër vendimit nr. 399, datë 14.06.2021 të Komisionit të Pavarur të Kualifikimit.

Sot, në datën 26.10.2021, në Kolegjin e Posaçëm të Apelimit u hodh shorti për caktimin e trupit gjykues, kryesuesin e këtij trupi dhe relatorin e çështjes.

The Appeal Chamber has registered case (JR) no. 60/2021, dated 20.10.2021, corresponding to the appeal of the assessee Durim Hasa against decision no. 399 dated 14.06.2021, of the Independent Qualification Commission.

Today, on 26.10.2021, the lot was drawn in the Appeal Chamber to appoint the trial panel, the presiding judge of this panel and the case rapporteur.

Kolegji i Posaçëm i Apelimit zhvilloi sot, më datë 26.10.2021, ora 10:00, seancën gjyqësore publike të çështjes (JR) 21/2021, datë 29.04.2021 që i përket ankimit të Komisionerit Publik kundër vendimit të Komisionit të Pavarur të Kualifikimit nr. 332, datë 12.01.2021, që lidhet me subjektin e rivlerësimit Lindita Male (Ziguri).

Në përgjigje të kërkesave të Komisionerit Publik, por edhe pas vlerësimit për nevojën e kryerjes së disa veprimeve hetimore, me vendim të ndërmjetëm, me shumicë votash, bazuar në nenet 45, 49 dhe 50 të ligjit 84/2016, trupi gjykues vendosi të zhvillojë hetime të mëtejshme lidhur me çështjen.

Trupi gjykues vendosi t’u drejtohet për dokumentacion dhe informacione shtesë për subjektin e rivlerësimit dhe dy persona të lidhur me të, F.M dhe A.Gj., institucioneve të mëposhtme: Prokurorisë pranë Gjykatës së Shkalls së Parë Tiranë, Gjykatës së Rrethit Gjyqësor Tiranë, Agjencisë së Trajtimit të Kredive, Drejtorisë së Përgjithshme të Gjendjes Civile, disa shoqërive tregtare, si dhe një banke të nivelit të dytë.

Në pritje të mbërritjes së akteve të kërkuara në zbatim të vendimit të ndërmjetëm, trupi gjykues vendosi të shtyjë seancën gjyqësore për në datën 18.11.2021, ora 10:00.

Seanca gjyqësore publike do të zhvillohet në ambientet e Kolegjit të Posaçëm të Apelimit, në adresën: Bulevardi “Dëshmorët e Kombit”, nr.3. Tiranë.

Today, on 28.10.2021, at 10:00 AM, the Appeal Chamber held the public hearing of case (JR) 43/2020, dated 30.09.2020, corresponding to the appeal of the Public Commissioner against decision no. 273, dated 10.07.2020 of the Independent Qualification Commission, related to the assessee Alkelina Gazidedja.

During the submissions of the appeal grounds, the Public Commissioner, with regard to asset assessment, stated that the assessee, Mrs. Gazidedja, has made an inaccurate and insufficient declaration and does not justify her assets with legitimate sources.

With regard to the proficiency assessment, the Public Commissioner held that the noticed shortcomings are such that do not justify and do not establish the conviction that the assessee should be confirmed in office. The Public Commissioner requested the amendment of decision no. 273, dated 10.07.2020, of the Independent Qualification Commission and dismissal from office of the assessee Alkelina Gazidedja.

The legal representative and the assessee herself, Mrs. Gazidedja, objected in detail the grounds of the appeal, considering them unfounded in law and evidence and the claims of the Public Commissioner as contradictory and unsubstantiated.

During the submission of her rebuttals, Ms. Gazidedja referred to the four decisions of the High Inspector of Justice related to cases tried by her, which the Independent Qualification Commission had addressed to this institution in the context of the proficiency assessment criterion of the assessee.

The Public Commissioner requested that such decision be made available and be acquainted with, in order to maintain in particular a position with their respect, as well as with regard to the submissions of the assessee in this hearing.

In response to this request, the trial panel decided to adjourn the public hearing until 01.11.2021, at 14:00.

Kolegji i Posaçëm i Apelimit zhvilloi sot, më datë 28.10.2021, ora 10:00, seancën gjyqësore publike të çështjes (JR) 43/2020, datë 30.09.2020 që i përket ankimit të Komisionerit Publik kundër vendimit të Komisionit të Pavarur të Kualifikimit nr. 273, datë 10.07.2020, që lidhet me subjektin e rivlerësimit Alkelina Gazidedja.

Gjatë paraqitjes së shkaqeve të ankimit, sa i përket kriterit të pasurisë, Komisioneri Publik deklaroi se subjekti i rivlerësimit, znj. Gazidedja, ka kryer deklarim të pasaktë e të pamjaftueshëm dhe nuk justifikon me burime të ligjshme pasurinë e saj.

Lidhur me kriterin e aftësive profesionale, Komisioneri Publik vlerësoi se mangësitë e vërejtura janë të tilla që nuk justifikojnë dhe nuk krijojnë bindjen se subjekti i rivlerësimit duhet të konfirmohet në detyrë. Komisioneri Publik kërkoi ndryshimin e vendimit nr. 273, datë 10.07.2020, të Komisionit të Pavarur të Kualifikimit dhe shkarkimin nga detyra të subjektit të rivlerësimit Alkelina Gazidedja.

Përfaqësuesja ligjore dhe subjekti i rivlerësimit, znj. Gazidedja, kundërshtuan në mënyrë të detajuar shkaqet e ankimit, duke i cilësuar ato të pabazuara në ligj e në prova dhe pretendimet e Komisionerit Publik, kontradiktore dhe të pambështetura.

Gjatë prapësimeve të saj, znj. Gazidedja iu referua katër vendimeve të Inspektorit të Lartë të Drejtësisë për çështje të gjykuara prej saj, që Komisioni i Pavarur i Kualifikimit ia kishte adresuar këtij institucioni në kuadër të vlerësimit të kriterit të aftësive profesionale të subjektit të rivlerësimit.

Komisioneri Publik kërkoi t’i vihen në dispozicion dhe të njihet me këto vendime, me qëllim që  të mbajë një qëndrim specifikisht për to, por edhe lidhur me parashtrimet e sotme të subjektit të rivlerësimit.

Në përgjigje të kësaj kërkese, trupi gjykues vendosi të shtyjë seancën gjyqësore publike për në datën 01.11.2021, ora 14:00.

Seanca gjyqësore publike do të zhvillohet në ambientet e Kolegjit të Posaçëm të Apelimit, në adresën: Bulevardi “Dëshmorët e Kombit”, nr.3. Tiranë.
