Kolegji i Posaçëm i Apelimit zhvilloi sot, më datë 16.11.2021, ora 10:00, seancën gjyqësore publike të çështjes (JR) 12/2021, datë 03.03.2021, që i përket ankimit të Komisionerit Publik kundër vendimit nr. 324, datë 11.12.2020, të Komisionit të Pavarur të Kualifikimit që lidhet me subjektin e rivlerësimit Sokol Ngresi.

Para paraqitjes së konkluzioneve përfundimtare, Komisioneri Publik bëri me dije se dëshmitari F.K. kishte paraqitur ditën e djeshme në institucionin e Komisionerëve Publikë disa akte lidhur me një kallëzim të tij drejtuar Prokurorisë së Posaçme Kundër Korrupsionit dhe Krimit të Organizuar (SPAK) ndaj dy ekspertëve kriminalistë të Institutit të Drejtorisë së Policisë Shkencore dhe subjektit të rivlerësimit.

I pyetur nga kryesuesja e seancës nëse kishte ndonjë kërkesë procedurale lidhur me aktet, Komisioneri Publik sqaroi se ishte shprehur vetëm në kuadër të transparencës me publikun dhe se e linte në çmim të gjykatës vendimmarrjen lidhur me to.

Pasi kryesuesja konfirmoi se Kolegji ishte në dijeni dhe kishte administruar aktet e paraqitura, trupi gjykues vendosi të vijohej me paraqitjen e konkluzioneve përfundimtare, duke vlerësuar se praktika e administruar nuk ndikon në procesin që po zhvillohet në Kolegj dhe do të jetë objekt verifikimi/hetimi dhe vlerësimi nga organet kompetente.

Gjatë paraqitjes së konkluzioneve përfundimtare, Komisioneri Publik deklaroi se subjekti i rivlerësimit nuk kishte arritur të provonte të kundërtën e shkaqeve të ankimit dhe se ka kryer deklarim të pasaktë, të pamjaftueshëm dhe ka mungesë të burimeve të ligjshme për krijimin e pasurisë së tij. Komisioneri Publik kërkoi ndryshimin e vendimit nr. 324, datë 11.12.2020, të Komisionit të Pavarur të Kualifikimit dhe shkarkimin nga detyra të subjektit të rivlerësimit Sokol Ngresi.

Subjekti i rivlerësimit kundërshtoi shkaqet e ankimit të Komisionerit Publik dhe deklaroi se nëpërmjet provave dhe argumentave ka arritur të provojë të gjitha pretendimet e tij. Subjekti i rivlerësimit i kërkoi Kolegjit mospranimin e ankimit të Komisionerit Publik, duke pretenduar se është depozituar jashtë afateve ligjore dhe në alternativë lënien në fuqi të vendimit nr. 324, datë 11.12.2020, të Komisionit të Pavarur të Kualifikimit.

Trupi gjykues, pasi dëgjoi bisedimet përfundimtare të palëve, u tërhoq për marrjen e vendimit përfundimtar, të cilin do ta shpallë më datë 24.11.2021, ora 15:00.

Seanca gjyqësore publike do të zhvillohet në ambientet e Kolegjit të Posaçëm të Apelimit, në adresën: Bulevardi “Dëshmorët e Kombit”, nr.3. Tiranë.

Today, on 16.11.2021, at 10:00, the Appeal Chamber held the public hearing of case (JR) 12/2021, dated 03.03.2021, corresponding to the appeal of the Public Commissioner against decision no. 324, dated 11.12.2020, of the Independent Qualification Commission related to the assessee Sokol Ngresi.

Prior to the submission of the final conclusions, the Public Commissioner informed the parties that the witness F.K. had filed yesterday with the institution of Public Commissioners several acts related to a denunciation to the Special Prosecution office against Corruption and Organized Crime (SPAK) against the two forensic experts of the Institute of the Scientific Police Directorate and the assessee.

When questioned by the presiding judge if there were any procedural requests with regard to the submitted acts, the Public Commissioner clarified that he had made this statement only in the context of transparency with the public and that he left the decision regarding them at the court appreciation.

Once the presiding judge confirmed that the AC was notified and had administered the submitted acts, the trial panel decided to proceed with the submission of the final conclusions, assessing that the administered practice does not affect the proceedings at the Appeal Chamber and they shall be subject to verification/investigation and evaluation by the competent bodies.

During the submission of the final conclusions, the Public Commissioner stated that the assessee had failed to prove the opposite of the appeal grounds and that he had made an inaccurate, insufficient declaration and lacked legitimate sources for the creation of his assets. The Public Commissioner requested the amendment of decision no. 324, dated 11.12.2020, of the Independent Qualification Commission and dismissal from office of the assessee Sokol Ngresi.

The assessee contradicted the appeal grounds of the Public Commissioner and stated that through evidence and arguments he has managed to prove all his claims. The assessee requested the Chamber to rebut the appeal of the Public Commissioner, claiming that it was filed beyond the legal time limits and, alternatively, the upholding of decision no. 324, dated 11.12.2020, of the Independent Qualification Commission.

The trial panel, after hearing the final conclusion of the parties, withdrew to make the final decision, to be announced on 24.11.2021, at 15:00 h.

The public hearing shall take place at the premises of the Appeal Chamber, at: Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
