The Appeal Chamber held on February 11, 2019, the consecutive hearing of case (JR) no. 13/2018, dated 07.09.2018, corresponding to the appeal of the Public Commissioner against decision no.32, dated 05.07.2018 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Ms. Alma Brati.
During today’s hearing the assessee requested the adjudication panel to collect in the capacity of evidence two documents issued by Italian regional state authorities. The Public Commissioner held that these acts do not specify in detail the shares of the lawful sources of incomes of each related other persons to the assessee. Following the submissions, the adjudication panel decided:
- To allow the collection of the evidences submitted by the assessee, as follows: documents issued by the respective authorities, agency “Entrate”, related to the taxes paid by citizen M.P. for the time period 2010-2016, and the official document issued by the state bailiff dated 07.02.2019, certifying the fact that the entity M.P. has no liability to the state or third parties.
- To revoke the interim decision of the adjudication panel dated 18.12.2018 in requesting official written documentation on the monthly income, indicating taxes withheld by the Italian state for the other related persons: M.P and L.P.
- The adjudication panel, by a majority vote, decided to not open the investigation regarding the three submissions filed with the AC by citizens: C.I., M.B. and B.R, as the submitted circumstances do not constitute evidence for the re-evaluation criteria.
The adjudication panel decided to adjourn the hearing on 25.03.2019, at 10:00 h., to inform the assessee on the results of the financial analysis to be carried out by the Legal Service Unit of the Appeal Chamber, in view of the evidences submitted by the assessee and other evidences collected ex officio by the adjudication panel.
The hearing shall be held at the premises of the Appeal Chamber, at: Bulevardi “Dëshmorët e Kombit”, nr.3. Tirana.
