The Appeal Chamber held on 27.10.2025, at 11:00, the public hearing of case (JR) 31/2023, dated 17.07.2023, pertaining to the appeal of the assessee Armand Gurakuqi against decision no. 652, dated 28.04.2023 of the Independent Qualification Commission.

The trial panel heard the assessee Armand Gurakuqi as he submitted his explanations with respect to the factual situation related to the loan relationship between his spouse and Mr. F. Sh., as well as the cooperation relationship between her and Mr. Z. Z., partner at the investment company “A.C.” Shpk. The assessee objected to the decision of the Independent Qualification Commission, maintaining that it is unfair and unfounded to link his name with the violation of public trust in the justice system, since there is no evidence or circumstance to prove a conflict-of-interest situation, which could lead to a violation of trust. In support of his claims, the assessee filed several new acts, which he requested the trial panel to collect them as evidence.

Subsequently, the assessee responded to several questions that the case rapporteur addressed to him on behalf of the trial panel, to the purpose of the consideration of the case.

After being consulted, the trial panel decided:

• To non-administer as evidence the acts submitted by the assessee attached to the submissions of the hearing in camera dated 02.10.2025 – apart from the acts accessible from open sources in the NBC electronic system – as they fail to meet the requirements of Articles 47 and 49 of law 49/2012 “On administrative courts and adjudication of administrative disputes”, as amended, and Article 49, paragraph 6 (a), of Law no. 84/2016
• To non-administer as evidence the written acts cited in today’s hearing, as they do lack the proper legal form, such as communications via telephone applications and the 2021 annual periodic declaration.

Once the assessee stated that he had no other procedural requests, the trial panel decided to close the judicial review of the case and withdrew in chambers to make the final decision, which it shall announce on 03.11.2025, at 09:30.

The public hearing shall take place at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
