Today, on 22.06.2023, at 10:00h, the Appeal Chamber held the public hearing of case (JR) 37/2022, dated 01.09.2022, corresponding to the appeal of the Public Commissioner filed against decision no. 535, dated 26.05.2022, of the Independent Qualification Commission related to the assessee Bledar Bejko.

During the submission of the final conclusions, the Public Commissioner stated that the acts accepted as evidence by the Appeal Chamber, sent by the Prosecutor’s Office at the First Instance Court Durrës, as well as those submitted by the assessee, do not affect the appeal grounds filed for the three assessment criteria, that of assets, background and proficiency assessment. Standing by all the filed appeal ground, the Public Commissioner in conclusion requested the Appeal Chamber to amend decision no. 535, dated 26.05.2022, of the Independent Qualification Commission and the dismissal of the assessee from office.

The assessee objected the appeal grounds of the Public Commissioner filed for the three assessment criteria and in conclusion requested the Appeal Chamber to not accept the appeal, as lodged outside the legal time limits, not based on evidence and the law, and to rule on upholding of decision no. 535, dated 26.05.2022, of the Independent Qualification Commission.

After listening to the final requests of the parties, the trial panel decided to withdraw to make the final decision of the case, which shall be delivered on 26.06.2023, at 14:00h.

The public hearing shall take place in the premises of the Special Appeal Chamber, at: Bulevardi “Dëshmorët e Kombit”, nr. 3, Tirana.

    Gjatë paraqitjes së konkluzioneve përfundimtare, përfaqësuesi i Prokurorisë së Posaçme z. Klodian Braho deklaroi se, pas marrjes së provave të reja dhe analizimit të tyre rezultoi se problematikat e konstatuara për kriterin e vlerësimit të pasurisë janë shteruar gjatë procesit të zhvilluar në Kolegjin e Posaçëm të Apelimit, dhe në këto kushte, kërkoi nga trupi gjykues lënien në fuqi të vendimit nr. 539, datë 8.6.2022, të Komisionit të Pavarur të Kualifikimit, për subjektin e rivlerësimit z. Hysni Mulaj.
    Subjekti i rivlerësimit, përmes përfaqësueses ligjore, parashtroi se ashtu siç u referua edhe nga përfaqësuesi i Prokurorisë së Posaçme, u provua e kundërta e shkaqeve të ankimit në lidhje me kriterin e vlerësimit të pasurisë dhe kërkoi rikonfirmimin në detyrë.
    Trupi gjykues, pasi u njoh me qëndrimet përfundimtare të palëve, u tërhoq në dhomë këshillimi për marrjen e vendimit përfundimtar, të cilin do ta shpallë më datë 05.05.2025, në orën 12:00.
    Seanca publike do të zhvillohet në ambientet e Kolegjit të Posaçëm të Apelimit, në adresën: Bulevardi “Dëshmorët e Kombit”, nr. 3, Tiranë.

    The Appeal Chamber held on 07.04.2025, at 14:00, the public hearing of case (JR) 36/2022, dated 29.07.2022, pertaining to the appeal of the Public Commissioner against decision no. 539, dated 08.06.2022 of the Independent Qualification Commission, related to the assessee Hysni Mulaj.

    During the submission of the final conclusions, the representative of the Special Prosecution Office Mr. Klodian Braho stated that, following the delivery and analysis of the new evidence, it turned out that the issues identified with respect to the asset assessment criterion have been exhausted during the proceedings held at the Appeal Chamber, and under such circumstances, he requested the trial panel the upholding of decision no. 539, dated 08.06.2022, of the Independent Qualification Commission, for the assessee, Mr. Hysni Mulaj.

    The assessee, through his legal representative, submitted that, as also referred to by the representative of the Special Prosecution Office, it was proven the opposite of the appeal grounds related to the asset assessment criterion and requested his reconfirmation in office.

    The trial panel, after being acquainted with the final positions of the parties, withdrew in chambers to make the final decision, which it shall announce on 05.05.2025, at 12:00.

    The public hearing shall take place at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
