The trial panel of the Appeal Chamber, composed of judges, Rezarta Schuetz, presiding, Ina Rama, rapporteur, Albana Shtylla, Ardian Hajdari, Natasha Mulaj members, announced the decision on case (JR) no.21 / 2020 dated 26.06.2020, corresponding to the appeal of the Public Commissioner against decision no. 249, dated 06.03.2020 of the Independent Qualification Commission.

At the termination of the adjudication, pursuant to Article 66, paragraph 1/b, of Law no. 84/2016, “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, the trial panel unanimously decided:

To amend the Independent Qualification Commission decision no. 249, dated 06.03.2020, as follows:

  1. To terminate the re-evaluation process for the assessee Piro Samara, inspector at the former High Council of Justice.
  2. To declare the forfeit of the right of the assessee to be appointed as a judge or prosecutor of any level, a member of the High Judicial Council or High Prosecutorial Council, High Inspector of Justice or Prosecutor General, for a 15-year period.
  3. This decision is final and effective immediately.

    Kolegji i Posaçëm i Apelimit zhvilloi më datë 07.04.2025, ora 14:00, seancën gjyqësore publike të çështjes (JR) 36/2022, datë 29.07.2022, që i përket ankimit të Komisionerit Publik kundër vendimit të Komisionit të Pavarur të Kualifikimit, nr. 539, datë 08.06.2022, që lidhet me subjektin e rivlerësimit Hysni Mulaj.
    Gjatë paraqitjes së konkluzioneve përfundimtare, përfaqësuesi i Prokurorisë së Posaçme z. Klodian Braho deklaroi se, pas marrjes së provave të reja dhe analizimit të tyre rezultoi se problematikat e konstatuara për kriterin e vlerësimit të pasurisë janë shteruar gjatë procesit të zhvilluar në Kolegjin e Posaçëm të Apelimit, dhe në këto kushte, kërkoi nga trupi gjykues lënien në fuqi të vendimit nr. 539, datë 8.6.2022, të Komisionit të Pavarur të Kualifikimit, për subjektin e rivlerësimit z. Hysni Mulaj.
    Subjekti i rivlerësimit, përmes përfaqësueses ligjore, parashtroi se ashtu siç u referua edhe nga përfaqësuesi i Prokurorisë së Posaçme, u provua e kundërta e shkaqeve të ankimit në lidhje me kriterin e vlerësimit të pasurisë dhe kërkoi rikonfirmimin në detyrë.
    Trupi gjykues, pasi u njoh me qëndrimet përfundimtare të palëve, u tërhoq në dhomë këshillimi për marrjen e vendimit përfundimtar, të cilin do ta shpallë më datë 05.05.2025, në orën 12:00.
    Seanca publike do të zhvillohet në ambientet e Kolegjit të Posaçëm të Apelimit, në adresën: Bulevardi “Dëshmorët e Kombit”, nr. 3, Tiranë.

    The Appeal Chamber held on 07.04.2025, at 14:00, the public hearing of case (JR) 36/2022, dated 29.07.2022, pertaining to the appeal of the Public Commissioner against decision no. 539, dated 08.06.2022 of the Independent Qualification Commission, related to the assessee Hysni Mulaj.

    During the submission of the final conclusions, the representative of the Special Prosecution Office Mr. Klodian Braho stated that, following the delivery and analysis of the new evidence, it turned out that the issues identified with respect to the asset assessment criterion have been exhausted during the proceedings held at the Appeal Chamber, and under such circumstances, he requested the trial panel the upholding of decision no. 539, dated 08.06.2022, of the Independent Qualification Commission, for the assessee, Mr. Hysni Mulaj.

    The assessee, through his legal representative, submitted that, as also referred to by the representative of the Special Prosecution Office, it was proven the opposite of the appeal grounds related to the asset assessment criterion and requested his reconfirmation in office.

    The trial panel, after being acquainted with the final positions of the parties, withdrew in chambers to make the final decision, which it shall announce on 05.05.2025, at 12:00.

    The public hearing shall take place at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
