The Appeal Chamber opened on 09.04.2025, at 15:00, the public hearing of case (JR) 27/2022, dated 17.06.2022, pertaining to the appeal of the Public Commissioner against decision no. 521, dated 01.04.2022 of the Independent Qualification Commission, related to the assessee Erjon Shehaj.

Following the opening of the hearing, the presiding judge informed the court as follows:

On 08.04.2025, the assessee submitted with the Appeal Chamber a document entitled “Request for opening the investigation by the Appeal Chamber”. This act was filed both via email and directly by the assessee in the form of a written document signed by him. This request contained attached a judicial decision of the Court of Appeal of General Jurisdiction of Tirana. The trial panel, in the hearing dated 04.04.2025, decided to conclude the judicial investigation of the case and withdrew in chambers to make the final decision, a decision which it made in the deliberations it held on 04.04.2025, in the presence of the International Observer of the case. The request was filed a few days later, on 08.04.2025, and the panel was legally unable to consider any request that may be submitted by the parties after the final decision was made. For this reason, in compliance with the legal provisions, this request of the assessee was not taken into account by the panel, consequently, it shall continue with the announcement of the final decision taken by the panel on this case.

Subsequently, the trial panel of the Appeal Chamber, consisting of judges, Sokol Çomo, presiding, Albana Shtylla, rapporteur, Ina Rama, Mimoza Tasi, Natasha Mulaj, members, announced the decision on case no. 27/2022, dated 17.06.2022, pertaining to the appeal of the Public Commissioner against decision no. 521, dated 01.04.2022 of the Independent Qualification Commission, related to the assessee Erjon Shehaj.

At the conclusion of the trial, the trial panel, pursuant to Article 66, paragraph 1 (b) of Law no. 84/2016, “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, unanimously decided:

– The amendment of decision no. 521, dated 01.04.2022 of the Independent Qualification Commission and the dismissal from office of the assessee Erjon Shehaj.

– This decision is final and effective immediately.

    Në vijim të seancës së mëparshme, Drejtuesi i Prokurorisë së Posaçme z. Klodjan Braho deklaroi se është njohur në mënyrë të drejtëpërdrejtë me informacionin e klasifikuar pranë organit ligjzbatues, në funksion të përgatitjes së një kërkimi përfundimtar të qartë e objektiv për çështjen nën shqyrtim.

    Pasi u konsultua, trupi gjykues vendosi mbylljen e hetimit gjyqësor të çështjes dhe kryesuesja e seancës ftoi palët në paraqitjen e konkluzioneve përfundimtare.

    Drejtuesi i Prokurorisë së Posaçme z. Klodjan Braho deklaroi se pas njohjes me informacionin e klasifikuar pranë organit ligjzbatues, vlerëson se, me shpjegimet shtesë bindëse e të pranueshme në parashtrime si dhe pas vlerësimit të provave të paraqitura gjatë procesit gjyqësor të zhvilluar në Kolegj, subjekti i rivlerësimit arriti të shërojë shkaqet e ankimit. Përfundimisht, Drejtuesi i Prokurorisë së Posaçme z. Klodjan Braho Kërkoi lënien në fuqi të vendimit të Komisionit të Pavarur të Kualifikimit nr. 682, datë 10.07.2023, që lidhet me subjektin e rivlerësimit Enklid Gjini.

    Të njëjtin qëndrim përfundimtar me Drejtuesin e Prokurorisë së Posaçme ndau edhe subjekti i rivlerësimit.

    Pasi dëgjoi kërkimet përfundimtare të palëve, trupi gjykues vendosi mbylljen e shqyrtimit gjyqësor dhe u tërhoq në dhomë këshillimi për marrjen e vendimit përfundimtar, të cilin do ta shpallë më datë 15.01.2026, ora 15:00.

    Seanca publike do të zhvillohet në ambientet e Kolegjit të Posaçëm të Apelimit, në adresën: Bulevardi “Dëshmorët e Kombit”, nr. 3, Tiranë.

    The Appeal Chamber held on 12.01.2026, at 10:00, the public hearing of case (JR) 45/2023, dated 12.10.2023, pertaining to the appeal of the Public Commissioner against decision no. 682, dated 10.07.2023 of the Independent Qualification Commission, related to the assessee Enklid Gjini.

    Following the previous hearing, the Head of the Special Prosecution Office, Mr. Klodjan Braho, stated that he had been directly acquainted with the classified information at the law enforcement agency, in order to prepare a clear and objective final investigation into the case under review.

    After being consulted, the panel decided to close the judicial investigation of the case and the presiding judge invited the parties to present their final conclusions.

    The Head of the Special Prosecution Office, Mr. Klodjan Braho, stated that after being acquainted with the classified information provided by the law enforcement agency, he assessed that, considering the additional convincing and acceptable explanations in the submissions and after evaluating the evidence lodged during the judicial proceedings at the Appeal Chamber, the assessee managed to dismiss the appeal grounds. Finally, the Head of the Special Prosecution Office, Mr. Klodjan Braho, requested the upholding of decision no. 682, dated 10.07.2023 of the Independent Qualification Commission, related to the assessee Enklid Gjini.

    The assessee shared the same final position with the Head of the Special Prosecution Office.

    After hearing the final arguments of the parties, the trial panel decided to close the trial and withdrew in chambers to make the final decision, which it shall announce on 15.01.2026, at 15:00.

    The public hearing shall take place at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
