The trial panel of the Appeal Chamber, consisting of judges, Ina Rama, presiding, Sokol Çomo rapporteur, Mimoza Tasi, Natasha Mulaj, Rezarta Schuetz, members, announced the decision on case no. 47/2022, dated 01.11.2022, pertaining to the appeal of the assessee Bajram Breçani against decision no. 558, dated 06.09.2022 of the Independent Qualification Commission.

At the conclusion of the trial in chambers, the trial panel, pursuant to Article 66, paragraph 1 (b) of Law no. 84/2016, “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, by a majority vote, decided:

– Amendment of decision no. 558, dated 06.09.2022 of the Independent Qualification Commission and confirmation in office the assessee Bajram Breçani.

– This decision is final and effective immediately.

Announced in Tirana, today, on 24.04.2025.

    Gjatë paraqitjes së konkluzioneve përfundimtare, përfaqësuesi i Prokurorisë së Posaçme z. Klodian Braho deklaroi se, pas marrjes së provave të reja dhe analizimit të tyre rezultoi se problematikat e konstatuara për kriterin e vlerësimit të pasurisë janë shteruar gjatë procesit të zhvilluar në Kolegjin e Posaçëm të Apelimit, dhe në këto kushte, kërkoi nga trupi gjykues lënien në fuqi të vendimit nr. 539, datë 8.6.2022, të Komisionit të Pavarur të Kualifikimit, për subjektin e rivlerësimit z. Hysni Mulaj.
    Subjekti i rivlerësimit, përmes përfaqësueses ligjore, parashtroi se ashtu siç u referua edhe nga përfaqësuesi i Prokurorisë së Posaçme, u provua e kundërta e shkaqeve të ankimit në lidhje me kriterin e vlerësimit të pasurisë dhe kërkoi rikonfirmimin në detyrë.
    Trupi gjykues, pasi u njoh me qëndrimet përfundimtare të palëve, u tërhoq në dhomë këshillimi për marrjen e vendimit përfundimtar, të cilin do ta shpallë më datë 05.05.2025, në orën 12:00.
    Seanca publike do të zhvillohet në ambientet e Kolegjit të Posaçëm të Apelimit, në adresën: Bulevardi “Dëshmorët e Kombit”, nr. 3, Tiranë.

    The Appeal Chamber held on 07.04.2025, at 14:00, the public hearing of case (JR) 36/2022, dated 29.07.2022, pertaining to the appeal of the Public Commissioner against decision no. 539, dated 08.06.2022 of the Independent Qualification Commission, related to the assessee Hysni Mulaj.

    During the submission of the final conclusions, the representative of the Special Prosecution Office Mr. Klodian Braho stated that, following the delivery and analysis of the new evidence, it turned out that the issues identified with respect to the asset assessment criterion have been exhausted during the proceedings held at the Appeal Chamber, and under such circumstances, he requested the trial panel the upholding of decision no. 539, dated 08.06.2022, of the Independent Qualification Commission, for the assessee, Mr. Hysni Mulaj.

    The assessee, through his legal representative, submitted that, as also referred to by the representative of the Special Prosecution Office, it was proven the opposite of the appeal grounds related to the asset assessment criterion and requested his reconfirmation in office.

    The trial panel, after being acquainted with the final positions of the parties, withdrew in chambers to make the final decision, which it shall announce on 05.05.2025, at 12:00.

    The public hearing shall take place at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.

    Kolegji i Posaçëm i Apelimit zhvilloi më datë 22.04.2025, ora 11:30, seancën gjyqësore publike të çështjes (JR) 41/2024, datë 21.10.2024, që i përket ankimit të Komisionerit Publik kundër vendimit të Komisionit të Pavarur të Kualifikimit, nr. 762, datë 15.05.2024, që lidhet me subjektin e rivlerësimit Afrim Shehu.

    Gjatë paraqitjes së konkluzioneve përfundimtare, përfaqësuesi i Prokurorisë së Posaçme, z. Klodian Braho, deklaroi se subjekti i rivlerësimit ndodhet në kushtet e deklarimit të pasaktë dhe të pamjaftueshëm të pasurisë, sipas përcaktimeve të nenit 61, pika 3 e ligjit nr. 84/2016 dhe përfundimisht, i kërkoi Kolegjit ndryshimin e vendimit nr. 762, datë 15.05.2024, të Komisionit të Pavarur të Kualifikimit dhe shkarkimin nga detyra të subjektit të rivlerësimit, z. Afrim Shehu.

    Përfaqësuesja ligjore e subjektit të rivlerësimit kundërshtoi ankimin si të pambështetur në ligj e në prova dhe i kërkoi Kolegjit të mbajë në konsideratë faktin se pasaktësitë në deklarimin e pasurisë, bazuar edhe në parimin e proporcionalitetit, nuk mund të përbëjnë rrethana që cenojnë besueshmërinë e subjektit të rivlerësimit për kriterin e pasurisë. Përfaqësuesja ligjore, përfundimisht, i kërkoi Kolegjit lënien në fuqi të vendimit nr. 762, datë 15.05.2024, të Komisionit të Pavarur të Kualifikimit.

    Pasi dëgjoi konkluzionet përfundimtare të palëve, trupi gjykues vendosi mbylljen e shqyrtimit gjyqësor të çështjes dhe u tërhoq në dhomë këshillimi për marrjen e vendimit përfundimtar, të cilin do ta shpallë më datë 08.05.2025, ora 14:30.

    Seanca publike do të zhvillohet në ambientet e Kolegjit të Posaçëm të Apelimit, në adresën: Bulevardi “Dëshmorët e Kombit”, nr. 3, Tiranë.

    The Appeal Chamber held on 22.04.2025, at 11:30, the public hearing of case (JR) 41/2024, dated 21.10.2024, pertaining to the appeal of the Public Commissioner against decision no. 762, dated 15.05.2024 of the Independent Qualification Commission, related to the assessee Afrim Shehu.

    During the submission of the final conclusions, the representative of the Special Prosecution Office, Mr. Klodian Braho, stated that the assessee is found in terms of incorrect and insufficient declaration of assets, according to the provisions of Article 61, paragraph 3 of Law no. 84/2016 and in conclusion he requested the Chamber the amendment of decision no. 762, dated 15.05.2024, of the Independent Qualification Commission and the dismissal from office of the assessee, Mr. Afrim Shehu.

    The legal representative of the assessee challenged the appeal as unfounded in law and evidence and requested the trial panel to take into account the fact that inaccuracies in the declaration of assets, supported also on the principle of proportionality, cannot constitute circumstances that undermine the credibility of the assessee for the asset assessment criterion. The legal representative finally requested the Chamber the upholding of decision no. 762, dated 762, dated 15.05.2024, of the Independent Qualification Commission.

    After hearing the final conclusions of the parties, the trial panel decided to close the judicial review of the case and withdrew in chambers to make the final decision, which it shall announce on 08.05.2025, at 14:30.

    The public hearing shall take place at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
