The Appeal Chamber held on 14.09.2025, at 10:00, the public hearing of case (JR) 12/2024, dated 29.03.2024, pertaining to the appeal of the Public Commissioner against decision no. 736, dated 31.01.2024 of the Independent Qualification Commission, related to the assessee Gentian Habazaj.

The representative of the Head of the Special Prosecution Office, Mr. Adnan Xholi, stated during the submission of the final conclusions, that, after evaluating the submissions of the assessee in relation to the acts in the case file, it was proven the continuity of the legitimate income of his parents over the years, although they are not legally considered persons related to the assessee. Mr. Xholi stated that the issues identified regarding the assets created by his parents before Mr. Habazaj assumed the prosecutor’s office do not place him in terms of insufficient declaration of assets.

As to the proficiency assessment criterion, Mr. Xholi stated that an appeal ground based on one of the denunciations has been remedied, while there are some shortcomings observed during the handling of criminal proceedings by him during the exercise of his office that are not to such extent as to place him before the disciplinary measure of dismissal from office.

Finally, the representative of the Head of the Special Prosecution Office Mr. Adnan Xholi requested the Appeal Chamber the upholding of decision no. 736, dated 31.01.2024 of the Independent Qualification Commission.

Subsequently, the legal representative and the assessee provided in summary their explanations regarding the appeal grounds, stating that their opposite was proven, as well as the fact that the declarations of Mr. Habazaj have always been accurate, clear and consistent. The assessee finally requested the Chamber to uphold the decision no. 736, dated 31.01.2024 of the Independent Qualification Commission.

After hearing the final conclusions of the parties, the trial panel decided to close the judicial review of the case and withdrew in chambers to make the final decision, which it shall announce on 17.10.2025, at 11:00.

The public hearing shall take place at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.

    Kolegji i Posaçëm i Apelimit zhvilloi më datë 14.09.2025, ora 10:00, seancën gjyqësore publike të çështjes (JR) 12/2024, datë 29.03.2024, që i përket ankimit të Komisionerit Publik kundër vendimit të Komisionit të Pavarur të Kualifikimit nr. 736, datë 31.01.2024, për subjektin e rivlerësimit Gentian Habazaj.

    Gjatë paraqitjes së konkluzioneve përfundimtare, përfaqësuesi i Drejtuesit të Prokurorisë së Posaçme z. Adnan Xholi deklaroi se, pas vlerësimit të parashtrimeve të subjektit të rivlerësimit në raport me aktet në dosje, u provua vazhdimësia e të ardhurave të ligjshme të prindërve të tij ndër vite, edhe pse ata nuk konsiderohen ligjërisht persona të lidhur me subjektin e rivlerësimit. Z. Xholi deklaroi se problemet e konstatuara lidhur me pasurinë e krijuar nga prindërit para se z. Habazaj të merrte detyrën e prokurorit, nuk e vendosin atë në kushtet e deklarimit të pamjaftueshëm të pasurisë.

    Lidhur me kriterin e vlerësimit profesional, z. Xholi deklaroi se është shëruar një shkak ankimor i bazuar në një prej denoncimeve, ndërkohë që disa mangësi të vërejtura gjatë trajtimit të procedimeve penale prej tij gjatë ushtrimit të dteyrës, nuk janë të tilla që ta vendosin para masës disiplinore të shkarkimit.

    Përfundimisht, përfaqësuesi i Drejtuesit të Prokurorisë së Posaçme z. Adnan Xholi i kërkoi Kolegjit lënien në fuqi të vendimit të Komisionit të Pavarur të Kualifikimit nr. 736, datë 31.01.2024.

    Në vijim, përfaqësuesi ligjor dhe subjekti i rivlerësimit dhanë në mënyrë të përmbledhur shpjegimet e tyre lidhur me shkaqet e ankimit, duke deklaruar se u provua e kundërta e tyre, si dhe fakti që deklarimet e z. Habazaj kanë qenë gjithmonë të sakta, të qarta dhe jo kontradiktore. Subjekti i rivlerësimit i kërkoi përfundimisht Kolegjit lënien në fuqi të vendimit të Komisionit të Pavarur të Kualifikimit nr. 736, datë 31.01.2024.

    Pasi dëgjoi konkluzionet përfundimtare të palëve, trupi gjykues vendosi mbylljen e shqyrtimit gjyqësor të çështjes dhe u tërhoq në dhomë këshillimi për marrjen e vendimit përfundimtar, të cilin do ta shpallë më datë 17.10.2025, ora 11:00.
