Today, on 05.06.2023, at 10:00, the Appeal Chamber held the public hearing of case (JR) 6/2021, dated 26.01.2021, pertaining to the appeal of the Public Commissioner and the appeal of the assessee Irena Brahimi against decision no. 276, dated 21.07.2020, of the Independent Qualification Commission.

At the onset of the hearing, the assessee, Mrs. Irena Brahimi, filed a document of the postal service with respect to the time period of the submission of her appeal against decision no. 276, dated 21.07.2020, of the Independent Qualification Commission, an act accepted as evidence by the court.

Following the interim decision of the previous hearing dated 11.05.2023, the parties debated about the preliminary financial analysis carried out by the Appeal Chamber, regarding the appeal grounds of the Public Commissioner, as well as the claims of the assessee related to the assessee assessment criteria.

The assessee, Mrs. Irena Brahimi requested some additional time to take a stand regarding some of the points of the today’s submissions of the Public Commissioner, which according to her, exceeded the appeal. In relation to this request, the trial panel assessed that the assessee may re-debate this issue during the submission of the final conclusions. The AC accepted as evidence two new documents, filed by the assessee, Mrs. Irena Brahimi, in support of her claims regarding the preliminary financial analysis.

In accordance with the interim decision of the hearing dated 11.05.2023, the assessee took a position regarding the information on a publication of a media website, part of the appeal of the Public Commissioner in the context of the proficiency assessment criteria. The assessee requested the court to disagree to examine further this information, as it does not meet the criteria of a denunciation, under Article 53 of Law no. 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”.

In this context, in view of the judicial investigation, the Public Commissioner requested the Chamber to address the High Court to the purpose of administering the judicial file of a criminal case pending before this court, related to the information published in the media. The court accepted this request of the Public Commissioner and pending the documentation as well as its forwarding to the parties, decided to adjourn the hearing to July 6, 2023, at 10:00.

The public hearing will take place at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
