The Appeal Chamber held on July 24, 2019, at 10:00 h, the public hearing of case (JR) no. 35/2018, dated 23.11.2018, corresponding to the appeals of the Public Commissioner and assessee Valbona Bala (Pajo) against decision no. 65 dated 13.09.2018 of the Independent Qualification Commission that has ruled the termination of the transitional re-evaluation of the assessee Valbona Bala (Pajo).
During this hearing the adjudication panel decided to review both appeals simultaneously, the parties submitted their respective appeal grounds.
The Public Commissioner claimed that the IQC decision on the termination of the transitional re-evaluation of the assessee Valbona Bala (Pajo) is not fair, it does not exhaustively reason the specific nature of the legal status of the assessee, and it is made without verifying the free will to resignation of the assessee. Nevertheless, despite these claims, in view of the requests of the assessee in the appeal, the Public Commissioner requested the amendment of decision no. 65, dated 13.09.2018 of the Independent Qualification Commission, completing its enacting clause with the prohibition provided for in Article G, second paragraph, of the Annex to the Constitution.
The assessee stated that decision no. 65, dated 13.09.2018 of the Independent Qualification Commission on the termination of the re-evaluation is not reasoned, is not founded in evidences and it exceeds the legal powers of the Commission. Ms. Bala requested the Appeal Chamber the amendment of the decision no. 65, dated 13.09.2018 of the Independent Qualification Commission in its reasoning part, thereby removing the prohibition provided for in Article G, second paragraph, of the Annex to the Constitution.
Having decided to close the judicial review and following the submission of the final conclusions of the parties at trial, the adjudication panel withdrew to make the decision on the case, to be announced on 25.07.2019, at 13:30 h.
The public hearing shall be held at the premises of the Appeal Chamber, at: Bulevardi “Dëshmorët e Kombit”, nr.3. Tirana.
