The Appeal Chamber held on 03.10.2019, at 10:00 h, the public hearing of case (JR) no. 34/2018, dated 13.11.2018, corresponding to the appeal of the Public Commissioner against decision no. 62 dated 03.08.2018 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Artur Malaj.
During this hearing the Public Commissioner agreed to the results of the financial analysis of the Appeal Chamber, whereas the assessee submitted his objections with regard to this analysis, considering it unfair and unfounded in evidences.
The assessee requested the adjudication panel to collect as evidence several new acts, and the conduct of a new financial analysis by an independent accounting expert, in the view of an impartial process.
After deliberating, the adjudication panel decided to accept the request of the assessee on the collection of new evidences and dismiss his request on conducting an accounting expertise, considering it superfluous, under Article 49, paragraph 6, item ‘a’, of Law no. 84/2016.
In response to the request of the Public Commissioner for the provision of a reasonable time to make a statement with regard to the evidences in general, the adjudication panel decided to adjourn the hearing on 11.10.2019, at 11:00 h.
The public hearing shall be held at the premises of the Appeal Chamber, at: Bulevardi “Dëshmorët e Kombit”, nr.3. Tirana.
