Kolegji i Posaçëm i Apelimit zhvilloi më datë 16.12.2025, ora 09:00, seancën gjyqësore publike të çështjes (JR)17/2024, datë 21.05.2024, që i përket ankimit të Komisionerit Publik kundër vendimit të Komisionit të Pavarur të Kualifikimit nr.735, datë 31.01.2024, që lidhet me subjektin e rivlerësimit Dritan Nushi.

Gjatë paraqitjes së konkluzioneve përfundimtare, përfaqësuesi i Drejtuesit të Prokurorisë së Posaçme z. Klodjan Braho deklaroi se bazuar në shqyrtimin e akteve në dosje rezulton që mangësitë e vërejtura në kriterin e aftësive profesionale nuk janë në atë masë për t’u konsideruar serioze apo për të aplikuar masën e shkarkimit nga detyra. Z. Klodjan Braho çmoi se problematikat lidhur me kriterin e vlerësimit të pasurisë nuk kanë peshë në vlerësimin tërësor të çështjes dhe se subjekti i rivlerësimit dha shpjegime bindëse, sa i përket padijenisë së tij për ndërtimin e paligjshëm mbi një pasuri në përdorim të tij, si dhe mbi pasurinë në pronësi të prindërve të tij. Përfundimisht, përfaqësuesi i Drejtuesit të Prokurorisë së Posaçme i kërkoi Kolegjit lënien në fuqi të vendimit të Komisionit të Pavarur të Kualifikimit nr.735, datë 31.01.2024, që lidhet me subjektin e rivlerësimit Dritan Nushi.

Në vijim, subjekti i rivlerësimit ndau të njëjtin kërkim përfundimtar me përfaqësuesin e Drejtuesit të Prokurorisë së Posaçme.

Pasi trupi gjykues dëgjoi kërkimet përfundimtare të palëve, vendosi mbylljen e shqyrtimit gjyqësor të çështjes dhe u tërhoq në dhomë këshillimi për marrjen e vendimit përfundimtar të çështjes, të cilin do ta shpallë më datë 17.12.2025, ora 14:30.

Seanca publike do të zhvillohet në ambientet e Kolegjit të Posaçëm të Apelimit, në adresën: Bulevardi “Dëshmorët e Kombit”, nr. 3, Tiranë.

The Appeal Chamber held on 16.12.2025, at 09:00, the public hearing of case (JR)17/2024, dated 21.05.2024, pertaining to the appeal of the Public Commissioner against decision no. 735, dated 31.01.2024 of the Independent Qualification Commission, related to the assessee Dritan Nushi.

During the submission of the final conclusions, the representative of the Head of the Special Prosecution Office, Mr. Klodjan Braho, maintained that it turns out from the review of the acts of the case file, that the deficiencies observed in the proficiency assessment criterion are not to the extent to be considered serious or to apply the measure of dismissal from office. Mr. Klodjan Braho considered that the issues related to the asset assessment criterion have no weight in the overall evaluation of the case and that the assessee provided convincing explanations regarding his unawareness of the illegal construction on a property in his use, as well as on the property in the possession of his parents.

Finally, the representative of the Head of the Special Prosecution Office requested the Chamber the upholding of decision no. 735, dated 31.01.2024 of the Independent Qualification Commission, related to the assessee Dritan Nushi.

Subsequently, the assessee shared the same final request with the representative of the Head of the Special Prosecution Office.

Once the trial panel heard the final arguments of the parties, it decided to close the judicial review of the case and withdrew in chambers to make the final decision on the case, which it shall announce on 17.12.2025, at 14:30.

The public hearing shall take place at the premises of the Appeal Chamber, at the address: Bulevardi “Dëshmorët e Kombit”, no. 3, Tirana.
