Kolegji i Posaçëm i Apelimit zhvilloi më datë 25.11.2025, ora 11:00, seancën gjyqësore publike të çështjes (JR) 47/2023, datë 19.10.2023, që i përket ankimit të Komisionerit Publik kundër vendimit të Komisionit të Pavarur të Kualifikimit nr. 689, datë 24.07.2023, që lidhet me subjektin e rivlerësimit Ervin Pollozhani.

Gjatë paraqitjes së konkluzioneve përfundimtare, përfaqësuesi i Drejtuesit të Prokurorisë së Posaçme z. Klodjan Braho deklaroi se subjekti i rivlerësimit gjendet në kushtet e deklarimit të pasaktë e të pamjaftueshëm të pasurisë dhe se pretendimet e tij për të kundërtën e shkaqeve të ankimit mbeten në nivel deklarativ e të pambështetura në aktet në dosje. Përfaqësuesi i Drejtuesit të Prokurorisë së Posaçme i kërkoi përfundimisht Kolegjit ndryshimin e vendimit nr. 689, datë 24.07.2023 të Komisionit të Pavarur të Kualifikimit dhe shkarkimin nga detyra të subjektit të rivlerësimit Ervin Pollozhani.

Subjekti i rivlerësimit kundërshoi shkaqet e ankimit dhe dokumentin “gjetje dhe mendim” të paraqitur nga vëzhguesi ndërkombëtar i Operacionit Ndërkombëtar të Monitorimit dhe i kërkoi përfundimisht Kolegjit lënien në fuqi të vendimit nr. 689, datë 24.07.2023 të Komisionit të Pavarur të Kualifikimit, sipas tij, i bazuar në ligj e në prova, i marrë pas një hetimi të plotë, shterues dhe argumentues.

Pasi dëgjoi konkluzionet përfundimtare të palëve, trupi gjykues vendosi mbylljen e shqyrtimit gjyqësor të çështjes dhe u tërhoq në dhomë këshillimi për marrjen e vendimit përfundimtar, të cilin do ta shpallë më datë 15.12.2025, ora 15:00.

Seanca publike do të zhvillohet në ambientet e Kolegjit të Posaçëm të Apelimit, në adresën: Bulevardi “Dëshmorët e Kombit”, nr. 3, Tiranë.

The Appeal Chamber held on 25.11.2025, at 11:00, the public hearing of case (JR) 47/2023, dated 19.10.2023, pertaining to the appeal of the Public Commissioner against decision no. 689, dated 24.07.2023 of the Independent Qualification Commission, related to the assessee Ervin Pollozhani.

During the submission of the final conclusions, the representative of the Head of the Special Prosecution Office, Mr. Klodjan Braho stated that the assessee is found in terms of incorrect and insufficient declaration of assets and that his claims to the contrary of the appeal grounds remain at a declarative level and unsupported by the acts of the case file. The representative of the Head of the Special Prosecution Office ultimately requested the Appeal Chamber the amendment of decision no. 689, dated 24.07.2023 of the Independent Qualification Commission and the dismissal from office of the assessee Ervin Pollozhani.

The assessee disputed the appeal grounds and the document “findings and opinion” submitted by the International Observer of the International Monitoring Operation and finally requested the Chamber the upholding of decision no. 689, dated 24.07.2023 of the Independent Qualification Commission, which according to him, is supported on law and evidence, following a complete, exhaustive and argumentative investigation.

After hearing the final conclusions of the parties, the trial panel decided to close the judicial review of the case and withdrew in chambers to make the final decision, which it shall announce on 15.12.2025, at 15:00.

The public hearing shall take place at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.

Kolegji i Posaçëm i Apelimit zhvilloi më datë 05.12.2025, ora 10:00, seancën gjyqësore publike të çështjes (JR) 18/2024, datë 24.05.2024, që i përket ankimit të Komisionerit Publik kundër vendimit të Komisionit të Pavarur të Kualifikimit nr. 738, datë 22.02.2024, që lidhet me subjektin e rivlerësimit Gëzim Çopa.

Gjatë paraqitjes së konkluzioneve përfundimtare, përfaqësuesi i Drejtuesit të Prokurorisë së Posaçme, z. Adnan Xholi, i qëndroi shkaqeve të ankimit dhe deklaroi se gjatë procesit të zhvilluar në Kolegj, subjekti i rivlerësimit nuk paraqiti ndonjë akt të ri për të provuar të kundërtën e barrës së provës, duke u gjendur në kushtet e deklarimit të pasaktë e të pamjaftueshëm e me mungesë të burimeve financiare të ligjshme për të justifikuar krijimin e pasurive të tij. Përfaqësuesi i Drejtuesit të Prokurorisë së Posaçme deklaroi që veprimtaria hetimore e subjektit të rivlerësimit gjatë ushtrimit të detyrës afekton kriterin e vlerësimit të aftësive profesionale të tij dhe kërkoi që, problematikat në gjetjet e evidentuara në ankim të vlerësohen nga Kolegji edhe lidhur me kriterin e vlerësimit të figurës, sipas nenit 4, pika 2 të ligjit 84/2016, në kuadër të nenit 61, pika 5 të po këtij ligji. Përfundimisht, përfaqësuesi i Drejtuesit të Prokurorisë së Posaçme kërkoi ndryshimin e vendimit të Komisionit të Pavarur të Kualifikimit nr. 738, datë 22.02.2024 dhe shkarkimin nga detyra të subjektit të rivlerësimit Gëzim Çopa.

Subjekti i rivlerësimit deklaroi se pas shpjegimeve të dhëna prej tij bazuar në provat në dosje gjatë procesit të zhvilluar në Kolegj, përfaqësuesi i Drejtuesit të Prokurorisë së Posaçme nuk duhet t’u qëndronte shkaqeve të ankimit, pasi nëpërmjet provueshmërisë së akteve është arritur të përmbyset barra e provës. Përfundimisht, subjekti i rivlerësimit i kërkoi Kolegjit rrëzimin e ankimit të paraqitur nga përfaqësuesi i Drejtuesit të Prokurorisë së Posaçme, si të pabazuar në prova e ligj dhe lënien në fuqi të vendimit të Komisionit të Pavarur të Kualifikimit nr. 738, datë 22.02.2024.

Pasi dëgjoi konkluzionet përfundimtare të palëve, trupi gjykues vendosi mbylljen e shqyrtimit gjyqësor të çështjes dhe u tërhoq në dhomë këshillimi për marrjen e vendimit përfundimtar, të cilin do ta shpallë më datë 16.12.2025, ora 15:00

The Appeal Chamber held on 05.12.2025, at 10:00, the public hearing of case (JR) 18/2024, dated 24.05.2024, pertaining to the appeal of the Public Commissioner against decision no. 738, dated 22.02.2024 of the Independent Qualification Commission, related to the assessee Gëzim Çopa.

During the submission of the final conclusions, the representative of the Head of the Special Prosecution Office, Mr. Adnan Xholi, stood by the appeal grounds and stated that during the AC proceedings, the assessee filed no new act to prove the opposite of the burden of proof, being found in terms of incorrect and insufficient declaration and lack of legitimate financial sources to justify the creation of his assets. The representative of the Head of the Special Prosecution Office stated that the investigative activity of the assessee during the exercise of his office affects the proficiency assessment criterion and requested that the issues in the findings evidenced in the appeal be evaluated by the Chamber also in relation to the background assessment criterion, according to Article 4, paragraph 2 of Law 84/2016, in the framework of Article 61, paragraph 5 of this very law. Finally, the representative of the Head of the Special Prosecution Office requested the amendment of decision no. 738, dated 22.02.2024 of the Independent Qualification Commission and the dismissal from office of the assessee Gëzim Çopa.

The assessee stated that following his explanations, based on the evidence in the case file and during the AC proceedings, the representative of the Head of the Special Prosecution Office should not have stood by the appeal grounds, since the acts have dispelled the burden of proof. Finally, the assessee requested the Chamber the dismissal of the appeal filed by the representative of the Head of the Special Prosecution Office, as unfounded in evidence and law and the upholding of decision no. 738, dated 22.02.2024 of the Independent Qualification Commission.

After hearing the final conclusions of the parties, the trial panel decided to close the judicial review of the case and withdrew in chambers to make the final decision, which shall be announced on 16.12.2025, at 15:00.
