Kolegji i Posaçëm i Apelimit zhvilloi më datë 18.02.2025, ora 09:00, seancën gjyqësore publike të çështjes (JR) 19/2024, datë 29.05.2024, që i përket ankimit të Komisionerit Publik kundër vendimit të Komisionit të Pavarur të Kualifikimit, nr. 730, datë 10.01.2024, që lidhet me subjektin e rivlerësimit Valentin Preçi.

Gjatë paraqitjes së konkluzioneve përfundimtare, Drejtuesi i Prokurorisë së Posaçme deklaroi se gjatë procesit gjyqësor të zhvilluar në Kolegj, subjekti i rivlerësimit nuk arriti të provojë të kundërtën e shkaqeve të ankimit për të tria kriteret e vlerësimit. Z. Altin Dumani deklaroi se subjekti i rivlerësimit ka kryer deklarim të pasaktë dhe të pamjaftueshëm dhe nuk arriti të provojë burimin e ligjshëm të krijimit të pasurisë së tij. Lidhur me kriterin e vlerësimit të figurës, Drejtuesi i Prokurorisë së Posaçme deklaroi se subjekti i rivlerësimit ka kryer deklarim të pamjaftueshëm, ndërsa sa i përket kriterit të vlerësimit të aftësive profesionale, specifikisht konfliktit të interesit, deklaroi se ka rrethana që afektojnë sjelljen e subjektit të rivlerësimit gjatë ushtrimit të detyrës dhe që bien në kundërshtim me sjelljen dhe etikën e magjistratit.

Përfundimisht, Drejtuesi i Prokurorisë së Posaçme i kërkoi Kolegjit ndryshimin e vendimit të Komisionit të Pavarur të Kualifikimit, nr. 730, datë 10.01.2024 dhe shkarkimin nga detyra të subjektit të rivlerësimit Valentin Preçi.

Përfaqësuesja ligjore e subjektit të rivlerësimit kundërshtoi ankimin dhe i kërkoi përfundimisht Kolegjit mospranimin e tij, duke lënë në fuqi vendimin e Komisionit të Pavarur të Kualifikimit, nr. 730, datë 10.01.2024, që lidhet me subjektin e rivlerësimit Valentin Preçi, si një vendim tërësisht i bazuar në ligj e në prova dhe në parimin e objektivitetit, proporcionalitetit dhe paanshmërisë.

Pasi dëgjuan konkluzionet përfundimtare të palëve, trupi gjykues vendosi mbylljen e shqyrtimit gjyqësor të çështjes dhe u tërhoq në dhomë këshillimi për marrjen e vendimit përfundimtar, të cilin do ta shpallë më datë 26.02.2025, ora 15:00.

Seanca publike do të zhvillohet në ambientet e Kolegjit të Posaçëm të Apelimit, në adresën: Bulevardi “Dëshmorët e Kombit”, nr. 3, Tiranë.

    The Appeal Chamber held on 18.02.2025, at 09:00, the public hearing of case (JR) 19/2024, dated 29.05.2024, pertaining to the appeal of the Public Commissioner against decision no. 730, dated 10.01.2024 of the Independent Qualification Commission, related to the assessee Valentin Preçi.

    During the submission of the final conclusions, the Head of the Special Prosecution office stated that during the trial held at the Appeal Chamber, the assessee failed to prove the opposite of the appeal grounds for all three vetting criteria. Mr. Dumani held that the assessee has made an incorrect and insufficient declaration and failed to prove the legitimate source of creation of his assets. With regard to the background assessment criterion, the Head of the Special Prosecution office maintained that the assessee has made an insufficient declaration, while regarding the proficiency assessment criterion, namely the conflict of interest, he stated that there are circumstances that affect the behavior of the assessee during the exercise of his office and that are contrary to the conduct and ethics of the magistrate.

    Finally, the Head of the Special Prosecution office requested the Chamber the amendment of decision no. 730, dated 10.01.2024 of the Independent Qualification Commission, and the dismissal from office of the assessee Valentin Preçi.

    The legal representative of the assessee challenged the appeal and finally requested the Appeal Chamber its dismissal, upholding decision no. 730, dated 10.01.2024 of the Independent Qualification Commission, related to the assessee Valentin Preçi, as a decision supported entirely on law and evidence and on the principle of objectivity, proportionality and impartiality.

    After hearing the final conclusions of the parties, the trial panel decided to close the judicial review of the case and withdrew in chambers to make the final decision, to be announced on 26.02.2025, at 15:00.

    The public hearing shall take place at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
