Today, on 23.09.2022, at 09:00, the Appeal Chamber held the public hearing of case (JR) 42/2020, dated 30.09.2020, pertaining to the appeal of the Public Commissioner against decision no. 269, dated 01.07.2020, of the Independent Qualification Commission related to the assessee Valdete Hoxha.
The Public Commissioner, Mrs. Irena Nino, while expressing her position regarding the public’s denunciations, stated that they contain insufficient information or circumstances, in the view of Article 53 of Law 84/2016.
The assessee, Mrs. Valdete Hoxha, held the same stand and in support of her position filed several new acts, which the panel administered as evidence.
The trial panel, by a majority vote, decided to not investigate the public’s denunciations, as there are no facts or circumstances therein which could be considered valid to meet the criteria of Article 53 of Law no. 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”.
Once the parties declared that they had no further procedural requests, the trial panel decided to close the judicial review of the case and invited the parties to submit their final conclusions.
The Public Commissioner assessed that, from the judicial investigation and evaluation of the evidence administered, pursuant to the principle of objectivity and proportionality, no action can be taken against the IQC’s decision. Finally, the Public Commissioner requested the upholding of decision no. 269, dated 01.07.2020, of the Independent Qualification Commission.
The assessee as well, in conclusion, requested the upholding of decision no. 269, dated 01.07.2020, of the Independent Qualification Commission.
After hearing the final conclusions of the parties, the panel withdrew to make the final decision, to be announced on September 30, 2022, at 13:00.
The public hearing will take place in the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
