Today, on 17.07.2024, at 10:00, the Appeal Chamber held the public hearing of case (JR) 39/2023, dated 04.09.2023, pertaining to the appeal of the Public Commissioner against decision no. 661, dated 18.05.2023 of the Independent Commission of Qualification, related to the assessee Besnik Hoxha.
During the submission of the appeal grounds, the Public Commissioner held that the assessee failed to prove the contrary of the investigation results on the assets, proficiency and background assessment, as well as on ascertained cases of conflict of interest. The Public Commissioner requested the trial panel the amendment of decision no. 661, dated 18.5.2023, and the dismissal from office of the assessee, Mr. Besnik Hoxha.
The assessee, through his legal representative, objected to the Public Commissioner’s appeal grounds, considering them unsubstantiated in evidence and in the results of the administrative investigation. While claiming the opposite of the appeal grounds, the assessee filed two new documents, one of which the trial panel considered as an explanatory act in view of the submissions, while for the other, it maintained that it could be consulted online on the official website of the Supreme Court.
Once the parties declared that they had no further procedural requests, the trial panel invited them to submit their final conclusions. In terms when the Public Commissioner requested a reasonable time limit for presenting the final conclusions, the trial panel decided to postpone the hearing to 22.07.2024, at 10:00.
The public hearing shall take place at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
