Today, on 25.07.2024, at 09:00, the Appeal Chamber held the public hearing of case (JR) 29/2021, dated 28.05.2021, pertaining to the appeal of the Public Commissioner against decision no. 352, dated 01.03.2021 of the Independent Qualification Commission, related to the assessee Iliba Bezati.
During the submission of the final conclusions, the Public Commissioner, apart from the fact that he took into consideration some of the arguments in the objections of the assessee in view of the asset assessment criterion, held that the lack of legitimate financial sources reaches a value, for which the principle of proportionality cannot be applied. The Public Commissioner stated that the assessee fails to reach a reliable level regarding the asset assessment, while the factual circumstances regarding the proficiency assessment criterion remain unchanged.
Finally, the Public Commissioner requested the amendment of decision no. 352, dated 01.03.2021 of the Independent Qualification Commission and the dismissal from office of the assessee Iliba Bezati.
The assessee maintained that she reaches a reliable level for the asset and background assessment, and a qualifying score in the proficiency assessment, and that the conclusions of the Independent Qualification Commission for all three criteria are fair and supported on law. Finally, the assessee requested the upholding of decision no. 352, dated 01.03.2021 of the Independent Qualification Commission.
Following the hearing the final conclusions of the parties, the trial panel withdrew to make the final decision, which it will announce on 30.07.2024, at 10:00.
The public hearing shall take place at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
