Today, on 25.11.2024, at 10:00, the Appeal Chamber opened the public hearing of case (JR) 35/2022, dated 25.07.2022, pertaining to the appeal of the Public Commissioner against decision no. 537, dated 20.06.2022 of the Independent Qualification Commission, related to the assessee Florian Bonjaku.

During the verification of the presence of the parties, the presiding judge noted the absence of the Public Commissioner and announced that Mr. Florian Ballhysa had electronically notified the Chamber that he was unable to attend today’s hearing, for objective reasons. Given the case circumstances and the need to follow the proceedings at the Chamber, Mr. Ballhysa informed that the institution of Public Commissioners could not be represented at the hearing by the other Public Commissioner, Ms. Irena Nino, consequently, he requested the postponement of the public hearing.

The trial panel decided to accept the request of the Public Commissioner, adjourning the hearing to 02.12.2024, at 10:00.

The public hearing shall take place at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.

    On Tuesday, 10.12.2024, at 09:00, the Appeal Chamber shall consider in a public hearing case (JR) no. 23/2024, dated 25.06.2024, pertaining to the appeal of the Public Commissioner against decision no. 767, dated 29.05.2024 of the Independent Qualification Commission, related to the assessee Sofia Zhilla.

    The trial panel of this case shall consist of the following judges:

    Kolegji i Posaçëm i Apelimit çeli sot, më datë 06.12.2024, ora 09:00, seancën gjyqësore publike të çështjes (JR) 10/2022, datë 15.02.2022, që i përket ankimit të Komisionerit Publik kundër vendimit të Komisionit të Pavarur të Kualifikimit, nr. 479, datë 03.12.2021, që lidhet me subjektin e rivlerësimit Arben Dosti.

    Gjatë verifikimit të prezencës së palëve, kryesuesja e trupit gjykues konstatoi mungesën e subjektit të rivlerësimit, Arben Dosti. Avokatja Romina Zano, e pranishme në seancë, i paraqiti trupit gjykues një prokurorë të posaçme, nëpërmjet së cilës subjekti i rivlerësimit, z. Dosti, i delegonte të drejtat e përfaqësimit në procesin gjyqësor në Kolegj, pasi për pamundësi objektive, nuk mund të ishte i pranishëm. Avokatja, znj. Romina Zano, deklaroi se prokura që dispononte ishte një fotokopje dhe nuk ishte në formën e kërkuar nga ligji.

    I pyetur nga kryesuesja për qëndrimin e tij, Komisioneri Publik deklaroi se duke qenë se regjistrat noterialë janë regjistra publikë, mund të vërtetoheshin ekstremitetet e prokurës së posaçme, me qëllim legjitimimin e avokates në proces.

    Trupi gjykues, pasi u konsultua vendosi shtyrjen e seancës gjyqësore publike për datën 13.12.2024 ora 09:00, për t’i dhënë mundësi subjektit të rivlerësimit të paraqitet personalisht në seancë gjyqësore ose nëpërmjet një përfaqësuesi ligjor të pajisur me një akt përfaqësimi në formën e kërkuar nga ligji.

    Seanca publike do të zhvillohet në ambientet e Kolegjit të Posaçëm të Apelimit, në adresën: Bulevardi “Dëshmorët e Kombit”, nr.3. Tiranë.

    Today, on 06.12.2024, at 09:00, the Appeal Chamber held the public hearing of case (JR) 10/2022, dated 15.02.2022, pertaining to the appeal of the Public Commissioner against decision no. 479, dated 03.12.2021 of the Independent Qualification Commission, related to the assessee Arben Dosti.

    During the verification of the presence of the parties, the presiding judge noticed the absence of the assessee Arben Dosti. The attorney Romina Zano, present at the hearing, lodged with the panel a special power of attorney, through which the assessee, Mr. Dosti, provided her with representation rights in the trial at the Chamber, since due to objective impossibility, he could not attend it. The counsel, Ms. Romina Zano, stated that the power of attorney she had was her was a copy and not in the form required by law.

    When questioned by the presiding judge about his position, the Public Commissioner held that in order to legitimize the defense counsel in this proceeding, the extremities of the special power of attorney could be verified given that the notarial registers are public registers.

    The trial panel, after being consulted, decided to postpone the public hearing to 13.12.2024 at 09:00, to provide the assessee the opportunity to appear in person at the hearing or through a legal representative provided with a power of attorney in the form required by law.
