The Appeal Chamber held on 29.05.2025, at 10:00, the public hearing of case (JR) 39/2022, dated 07.09.2022, pertaining to the appeal of the Public Commissioner against decision no. 538, dated 07.06.2022 of the Independent Qualification Commission, related to the assessee Elona Alvora.
During the verification of the presence of the parties, the presiding judge announced that under Article 179/b, paragraph 8 of the Constitution of the Republic of Albania and Article 199 of the Civil Procedure Code determined the transfer of powers from the Public Commissioner to the Head of the Special Prosecution Office, represented in this case upon special authorization by the prosecutor of the Special Prosecution Office, Mr. Adnan Xholi, attending the hearing.
The representative of the Special Prosecution Office submitted the appeal grounds for the proficiency assessment, requesting the Chamber, based on its controlling jurisdiction, to carry out a reassessment of the actions and omissions of the assessee in some of the criminal cases administered by her, referring to the findings in the appeal grounds, since, according to him, the investigation of the Independent Qualification Commission in this context has been incomplete. Mr. Xholi requested the Chamber the opening of the judicial investigation of the case, in order to address the First Instance Court of General Jurisdiction of Vlora and the Prosecution Office at this court, to make available the complete acts of the criminal files. The representative of the Special Prosecution Office requested the Chamber to take the appeal into consideration and, in conclusion, to decide, alternatively, the amendment of decision no. 538, dated 07.06.2022 of the Independent Qualification Commission, or its upholding.
When questioned by the presiding judge regarding two public complaints received by the Chamber, the representative of the Special Prosecution Office, after being acquainted with the position of the assessee with their regard, stated that they contain no such grounds that would require further investigations.
The assessee, Ms. Elona Alvora, during the submission of the objections regarding the appeal grounds, provided summarily her explanations the circumstances of the criminal cases included in the appeal grounds, claiming that every action was taken in accordance with the procedural law.
As to the request of the representative of the Special Prosecution Office for the administration of acts of several criminal files, the assessee maintained that she considers that the two cases transferred to the High Inspector of Justice should not be considered by the AC, while she considered unnecessary the administration of acts of other cases.
After being consulted, the trial panel decided to open the judicial investigation and request the acts cited in the request submitted by the representative of the Special Prosecution Office, Mr. Xholi, informing that the parties will be notified in due course about the manner of communication of the requested acts.
Pending their delivery, it was decided the postponement of the hearing to 24.06.2025, at 13:00.
The public hearing shall take place at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
