The Appeal Chamber held on 18.06.2025, at 10:00, the public hearing of case (JR) 8/2023, dated 24.02.2023, pertaining to the appeal of the Public Commissioner against decision no. 600, dated 19.12.2022 of the Independent Qualification Commission, related to the assessee Robert Kote.
The presiding judge informed the parties that following the previous hearing, the assessee had submitted with the AC the summary decision of the Court of Appeal of General Jurisdiction, which was also forwarded to the representative of the Special Prosecution Office for evaluation purposes in the final conclusions.
Once the parties declared that they had no other procedural requests, the trial panel decided to close the judicial investigation and invited them to submit their final conclusions.
The representative of the Special Prosecution office, Mr. Klodian Braho, in reference to the new evidence lodged by the assessee during the AC proceedings, stated that his financial insufficiency is to such an extent that it does not violate the reliability with respect to the asset assessment criteria. According to Mr. Braho, as to the proficiency assessment and findings related to criminal proceedings handled by the assessee during the exercise of his office, it was proven that no deficiencies were found that could violate the public trust in the justice system. Finally, the representative of the Special Prosecution Office requested the upholding of decision no. 600, dated 19.12.2022 of the Independent Qualification Commission.
The assessee stated that, through the new evidence submitted during this proceedings, he managed to prove the opposite of the appeal, and finally requested the upholding of decision no. 600, dated 19.12.2022 of the Independent Qualification Commission and his confirmation in office.
After hearing the final conclusions of the parties, the trial panel decided to close the judicial review of the case and withdrew in chambers to make the final decision, which it shall announce on 03.07.2025, at 15:00.
The public hearing shall take place at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
