The Appeal Chamber held on 14.07.2025, at 14:00, the public hearing of case (JR) 43/2024, dated 05.11.2024, pertaining to the appeal of the Public Commissioner against decision no. 802, dated 23.09.2024 of the Independent Qualification Commission, related to the assessee Flora Çela.
During the submission of the final conclusions, the Head of the Special Prosecution Office, Mr. Altin Dumani, held that the assessee failed to prove the opposite of the appeal grounds even during the course of the judicial proceedings at the Chamber, failing to meet the constitutional criteria to achieve a qualifying level in the proficiency assessment. Finally, Mr. Dumani requested the Appeal Chamber the amendment of decision no. 802, dated 23.09.2024 of the Independent Qualification Commission, and the dismissal from office of the assessee Flora Çela.
During the submission of the final conclusions, Ms. Flora Çela stated that the measure of dismissal from office could be requested only if it were proven that the shortcomings during the exercise of the office were systematic, extremely serious, irremediable by the training program at the School of Magistrates, maintaining that in any case she has exercised her office according to the legal competences and internal conviction. Finally, the assessee requested the dismissal of the appeal as unfounded in evidence and law and the upholding of decision no. 802, dated 23.09.2024 of the Independent Qualification Commission.
After hearing the final conclusions of the parties, the trial panel decided to close the judicial review of the case and withdrew in chambers to make the final decision, to be announced on 23.07.2025, at 15:30.
The public hearing shall take place at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
