The Appeal Chamber held on 07.07.2025, at 10:00, the public hearing of case (JR) 43/2024, dated 05.11.2024, pertaining to the appeal of the Public Commissioner against decision no. 802, dated 23.09.2024 of the Independent Qualification Commission, related to the assessee Flora Çela.
The presiding judge announced that Article 179/b, paragraph 8 of the Constitution of the Republic of Albania and Article 199, paragraph 2 of the Civil Procedure Code have set forth the transfer of powers from the Public Commissioner to the Head of the Special Prosecution Office, Mr. Altin Dumani, present at the hearing.
During the submission of the appeal grounds, the Head of the Special Prosecution Office held that there are issues found with regard to the proficiency assessment criteria, such that they cannot be remedied with the training program of the School of Magistrates and that the assessee, Ms. Flora Çela, with her actions and omissions during the exercise of her office, has undermined public trust in the justice system. The Head of the Special Prosecution office requested the amendment of decision no. 802, dated 23.09.2024 of the Independent Qualification Commission and the dismissal from office of the assessee Flora Çela.
The assessee, during her objections, stated that the Public Commissioner’s appeal on the proficiency assessment criteria is not only unsupported on objective elements and factual data, but also contradicts the assessments that the relevant institutions of the justice system have carried out for Ms. Flora Çela regarding her professional skills. The assessee requested the dismissal of the appeal as unfounded in evidence and the upholding of decision no. 802, dated 23.09.2024 of the Independent Qualification Commission. The assessee lodged some new documents attached to the submissions, requesting the trial panel to collect them as evidence.
The Head of the Special Prosecution office agreed to accepting the documents submitted as evidence.
Subsequently, after the assessee heard several opinions of the International Observer of the International Monitoring Operation, and responded to several questions from him and the Head of the Special Prosecution Office to the purpose of the consideration of the case, the trial panel was consulted and decided to open the judicial investigation of the case, accepting as evidence the acts filed in writing by the International Monitoring Operation on 14.11.2024, as well as the acts filed by the assessee, along with the submissions.
Once the parties declared that they had no other procedural requests, the trial panel decided to close the judicial investigation and invited them to submit their final conclusions.
In order to provide the parties the necessary time to prepare their final conclusions, it decided to postpone the hearing to 14.07.2025, at 14:00.
The public hearing shall take place at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
