The Appeal Chamber held on 24.07.2025, at 11:00, the public hearing of case (JR) 6/2023, dated 03.02.2023, pertaining to the appeal of the Public Commissioner against decision no. 598, dated 13.12.2022 of the Independent Qualification Commission, related to the assessee Genci Mane.

The presiding judge announced that the Appeal Chamber has received the second responses of Tirana Universal Service Provider Power Supply System Operator, Fier Regional Directorate, and the Water Supply and Sewerage Company Sh.A, and they had been forwarded to the parties, who confirmed their acquaintances with them.

The representative of the Head of the Special Prosecution Office, Mr. Adnan Xholi, stated with regard to the responses, that there are no copies of acts on the basis of which contracts were concluded between these entities and the assessee.

The assessee maintained that they confirmed the position he held in the previous hearing, dated 14.07.2025, that the responses of the institutions were exhaustive, as such contracts do not exist.

Subsequently, to the purpose of the consideration of the case, the assessee responded to several questions of the rapporteur.

After administering as evidence the responses of the institutions and the positions of the parties held during today’s hearing, the trial panel decided to close the judicial investigation of the case and invited the parties to present their final conclusions.

During their submission, the representative of the Head of the Special Prosecution stated that even during the judicial proceedings conducted at the Appeal Chamber, the assessee failed to prove the opposite of the appeal grounds. Mr. Xholi assessed that the assessee is found in a situation of inaccurate and insufficient declaration and fails to cover his assets with legitimate sources. As to the proficiency assessment, Mr. Adnan Xholi requested the Chamber the assessment of repeated shortcomings, observed during the exercise of the office by the assessee, along with the issues in the asset assessment criterion, deciding the amendment of decision no. 598, dated 13.12.2022 of the Independent Qualification Commission and the dismissal from office of the assessee Genci Mane.

The assessee submitted his final conclusions, providing summarily his explanations in response to the appeal grounds and in reference to the evidence in the case file, finally requesting the Chamber the upholding of the decision no. 598, dated 13.12.2022 of the Independent Qualification Commission.

After hearing the final conclusions of the parties, the trial panel withdrew in chambers to make the final decision, which it shall announce on 29.07.2025, at 14:00.

The public hearing shall take place at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
