The Appeal Chamber held on 14.09.2025, at 10:00, the public hearing of case (JR) 12/2024, dated 29.03.2024, pertaining to the appeal of the Public Commissioner against decision no. 736, dated 31.01.2024 of the Independent Qualification Commission, related to the assessee Gentian Habazaj.
The representative of the Head of the Special Prosecution Office, Mr. Adnan Xholi, stated during the submission of the final conclusions, that, after evaluating the submissions of the assessee in relation to the acts in the case file, it was proven the continuity of the legitimate income of his parents over the years, although they are not legally considered persons related to the assessee. Mr. Xholi stated that the issues identified regarding the assets created by his parents before Mr. Habazaj assumed the prosecutor’s office do not place him in terms of insufficient declaration of assets.
As to the proficiency assessment criterion, Mr. Xholi stated that an appeal ground based on one of the denunciations has been remedied, while there are some shortcomings observed during the handling of criminal proceedings by him during the exercise of his office that are not to such extent as to place him before the disciplinary measure of dismissal from office.
Finally, the representative of the Head of the Special Prosecution Office Mr. Adnan Xholi requested the Appeal Chamber the upholding of decision no. 736, dated 31.01.2024 of the Independent Qualification Commission.
Subsequently, the legal representative and the assessee provided in summary their explanations regarding the appeal grounds, stating that their opposite was proven, as well as the fact that the declarations of Mr. Habazaj have always been accurate, clear and consistent. The assessee finally requested the Chamber to uphold the decision no. 736, dated 31.01.2024 of the Independent Qualification Commission.
After hearing the final conclusions of the parties, the trial panel decided to close the judicial review of the case and withdrew in chambers to make the final decision, which it shall announce on 17.10.2025, at 11:00.
The public hearing shall take place at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
