The Appeal Chamber held on 06.10.2025, at 13:00, the public hearing of case (JR) 55/2023, dated 24.11.2023, pertaining to the appeal of the Public Commissioner against decision no. 704, dated 09.10.2023 of the Independent Qualification Commission, related to the assessee Elidon Hysenaj.
The presiding judge announced that following the interim decision of the previous hearing, the trial panel had been directly acquainted with the classified information at the law enforcement institutions, also made known to the Independent Qualification Commission in the context of the case.
Once the parties declared that they had no other procedural requests, the trial panel decided to close the judicial investigation of the case and invited them to present their final conclusions.
The representative of the Head of the Special Prosecution Office, Mr. Klodian Braho, held that, even after being acquainted with the new evidence, the undertaking of investigative actions by the assessee in some cases remains unsubstantiated and unclear. Mr. Braho requested the Chamber to take into consideration the findings, to evaluate them in relation to the classified information with which it has become acquainted and, alternatively, to decide the amendment or the upholding of decision no. 704, dated 09.10.2023 of the Independent Qualification Commission.
The presiding judge of the trial panel requested the representative of the Head of the Special Prosecutor’s Office if he could present a final and not an alternative request on the case. Mr. Braho stated that he comes with this alternative request, as he has not been acquainted with the classified information of the law enforcement agencies.
The legal representative of the assessee maintained that this alternative request of the representative of the Head of the Special Prosecution Office identified no violation of procedural or substantive law, contains no alleged violated norm, final request or argumentation based on facts.
After being consulted, the trial panel decided to request the Head of the Special Prosecution Office and his representative to submit a specific, single request, without alternatives, for the decision under consideration, inviting them, if they deem it necessary, to access for consultation in the premises of the Chamber the classified file of the assessee, administered in the IQC file, as an integral part of it.
For this reason, the public hearing was postponed to 13.10.2025, at 10:00. This hearing will be held at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
