The Appeal Chamber held on 15.10.2025, at 09:00, the public hearing of case (JR) 37/2023, dated 02.08.2023, pertaining to the appeal of the Public Commissioner against decision no. 650, dated 27.04.2023 of the Independent Qualification Commission, related to the assessee Ylli Pjetërnikaj.
The trial panel decided to administer in the capacity of evidence a document which the assessee submitted in the previous hearing, in the form required by law.
Subsequently, during the submission of the final conclusions, the representative of the Head of the Special Prosecution office, Mr. Klodjan Braho, held that following the submissions of the assessee in connection with the acts in the case file, the legitimacy of the income from the household agricultural activity was proven, and that there is no evidence or doubt of any illegal activity of the assessee or his family members. Mr. Braho stated that the issues related to the asset assessment do not amount to such an extent that would place him before the disciplinary measure of dismissal from office.
As to the proficiency assessment criterion, Mr. Braho stated that some issued observed during the exercise of his office are not considered serious shortcomings, such as to have violated the fair resolution of the case.
Finally, the representative of the Head of the Special Prosecution Office Mr. Klodjan Braho, requested the Chamber the upholding of decision no. 650, dated 27.04.2023 of the Independent Qualification Commission.
Subsequently, the assessee provided in summary some explanations regarding the appeal grounds, stating that the fact that the legality of the agricultural household income was proven means that the grounds for the appeal have ceased and have been left out. The assessee finally requested the Chamber the upholding of decision no. 650, dated 27.04.2023 of the Independent Qualification Commission.
The International Monitoring Operation Observer then requested the representative of the Head of the Special Prosecution Office regarding the change in the final request. In response to the question, Mr. Braho explained that the Head of the Special Prosecution Office has previously held similar positions, which the trial panel has addressed as a withdrawal from the appeal and has interpreted according to its competences.
The trial panel, after being consulted, decided to close the judicial review of the case and withdrew in chambers to make the final decision, which it shall announce on 17.10.2025, at 12:00.
The public hearing shall take place at the premises of the Appeals Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
