The Appeal Chamber held on 16.10.2025, at 08:30, the public hearing of the case (JR) 38/2023, dated 04.09.2023, pertaining to the appeal of the Public Commissioner against decision no. 673, dated 15.06.2023 of the Independent Qualification Commission, related to the assessee Mirela Zavalani.
During the submission of the final conclusions, the representative of the Head of the Special Prosecution Office Mr. Adnan Xholi stated that, during the judicial proceedings at the Appeal Chamber, the assessee, Ms. Mirela Zavalani, failed to prove the contrary of the appeal grounds regarding the asset assessment criterion. According to Mr. Xholi, the statements of Ms. Zavalani are unclear and inaccurate in relation to the acts in the case file, making her statement unreliable and contradictory. The representative of the Head of the Special Prosecution Office requested the Chamber to assess certain banking transactions of the assessee’s spouse in the context of violating public trust in the justice system.
Finally, the representative of the Head of the Special Prosecution Office, Mr. Adnan Xholi requested the amendment of decision no. 673, dated 15.06.2023 of the Independent Qualification Commission and the dismissal from office of the assessee.
On the other hand, the assessee Ms. Zavalani, during the submission of the final conclusions, submitted in detail her explanations regarding the appeal, stating that the legitimacy of the source of creation of her assets was proven, that the minimal differences found do not have such relevance that could violate her financial reliability and do not leave a ground for the disciplinary measure of dismissal from office.
Finally, the assessee requested the Chamber the upholding of decision no. 673, dated 15.06.2023 of the Independent Qualification Commission.
Subsequently, the legal representative of the assessee assessed the appeal ground related to the violation of public trust in the justice system, unsupported by the relevant legal basis and as an appeal ground as a right declined, as it should have been submitted during the judicial debate stage.
After hearing the final conclusions of the parties, the trial panel withdrew in chambers to make the final decision, which it shall announce on 24.10.2025, at 09:30.
The public hearing shall take place at the premises of the Special Appeals Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
