Today, on 17.02.2021, at 13:00h, the Appeal Chamber held the public hearing of case (JR) 51/2020, dated 23.11.2020, corresponding to the appeal of the assessee Alaudin Malaj against decision no. 294, dated 15.09.2020, of the Independent Qualification Commission.
The assessee, based on Article 145, para 2 of the Constitution, submitted a request to the trial panel for the suspension of the trial, in order for the Panel to send to the Constitutional Court for consideration the case raised in the request by the assessee, Mr. Malaj.
After withdrawing for consultation, the trial panel rejected the request of the assessee, arguing that it is not found in terms of Article 145, para 2 of the Constitution, as it is not considered that any of the laws of the re-evaluation process is contrary to the Constitution.
Also, the trial panel, after considering all the requests and evidence filed by the assessee, declared the closure of the judicial investigation of the case and invited the assesse to submit the final conclusions.
Taking into account the request of the assessee for a reasonable time for the preparation of the final conclusions, the trial panel decided to adjourn the hearing until 23.02.2021, at 09:00 h.
The public hearing will take place in the premises of the Appeal Chamber, at: Boulevard “Dëshmorët e Kombit”, no.3. Tirana.
