The Appeal Chamber held today, on 17.03.2021, at 10:00, the public hearing of the case (JR) 46/2019, dated 25.09.2019, corresponding to the appeal of the Public Commissioner against decision no. 161, dated 18.06.2019, of the Independent Qualification Commission related to the assessee Kastriot Selita.
While verifying of the presence of the litigants, the presiding judge ascertained the presence of the Public Commissioner, Mr. Florian Ballhysa and of the assessee, Mr. Kastriot Selita, who stated that they had no claims regarding the composition of the trial panel, and confirmed that they had received the 12 denunciations filed against the assessee that had been made available to them by the Appeal Chamber.
After the presiding judge announced the opening of the hearing, the Public Commissioner stated the appeal grounds regarding the asset assessment criterion, and cited several legal issues that according to him, need to be evaluated and interpreted by the Appeal Chamber; he stated as well the need for further investigation. Regarding the proficiency assessment criteria, the Public Commissioner, referring to the submitted denunciations, deemed that the Independent Qualification Commission has not exhaustively investigated them. The Public Commissioner requested the Appeal Chamber to open a judicial investigation in order to investigate the appeal grounds and the eventual administration of new evidence.
The assessee stated his elaborated objections to the appeal grounds by the Public Commissioner, considering them as unfounded in law and evidence; while referring to the denunciations addressed to him, he stated that he has avoided the conflict of interest in any case during the exercise of duty. The assessee requested the Appeal Chamber that for the purpose of the case review, to accept as evidence the new acts that the assessee submitted during today’s hearing, attached to his submissions.
Taking into account the request of the Public Commissioner for a reasonable time to be acquainted and state his opinion regarding the content of new acts and denunciations submitted to the Appeal Chamber, the trial panel by consultation on the spot, decided to adjourn the public hearing to 01.04. 2021 at 10:00. The presiding judge stated that in the upcoming hearing, the trial panel shall as well state its opinion regarding the decision on whether to open the investigation and take as evidence the acts submitted by the assessee, or not.
The public hearing shall be held at the premises of the Appeal Chamber, at: Bulevardi “Dëshmorët e Kombit”, nr.3. Tiranë.
