Today, on 24.03.2021, at 10:00, the Appeal Chamber held the public hearing of case (JR) 26/2020, dated 01.07.2020, corresponding to the appeal of the assessee Edmond Hyka against decision no. 223, dated 20.12.2019 of the Independent Qualification Commission.
The assessee and his legal representative were heard by the trial panel regarding the submissions on the appeal grounds filed against decision no. 223, dated 20.12.2019 of the Independent Qualification Commission. The assessee requested the panel to collect as evidence the acts filed along with the appeal as well as some acts filed in the public hearing related to the asset assessment.
After being consulted, the trial panel decided to allow the collection as evidence of a part of the acts submitted by the assessee, while noticing that the remainder of the acts are part of the file of the Independent Qualification Commission, or are accessible through open sources of information.
Subsequently, in view of the review of the case, the rapporteur of the case addressed some questions to the assessee. To support his explanations regarding these questions, the assessee requested the trial panel to collect evidence by testimony, a request rejected by the trial panel under Article 49, para 6 (a) and (b), of Law no. 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”.
Once the assessee stated that there were no other procedural requirements and after the trial panel decided to close the judicial investigation, the assessee submitted the final conclusions on the case, requesting the amendment of decision no. 223, dated 20.12.2019 of the Independent Qualification Commission and his confirmation in office.
The trial panel decided to withdraw for making the final decision, to be announced on April 7, 2022, at 15:00.
The public hearing will take place at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
