Today, on 12.07.2023, at 10:30 a.m., the Appeal Chamber held the public hearing of case (JR) 23/2021, dated 10.05.2021, pertaining to the appeal of the assessee, Aleks Nikolli, against decision no. 290, dated 10.08.2020, of the Independent Qualification Commission.

The assessee submitted in detail his arguments related to the procedural violation of the Independent Qualification Commission, reflecting in the decision a conclusion about his property, a residential apartment in Lezha, with two side additions, such conclusion not of the majority, but of the case rapporteur. Following these arguments, the assessee held that decision no. 290, dated 10.08.2020 of the Independent Qualification Commission, was made in serious violation of the law.

Subsequently, the assessee requested the AC the collection as evidence of certain documents he filed attached to the appeal, as well as access some information from open sources.

Following the questions of the case rapporteur in view of the examination of the case and after being consulted, the trial panel, pursuant to Article 47 of Law no. 49/2012 “On administrative courts and adjudication of administrative disputes”, as amended, and Article 49, paragraph 6 (a) of Law no. 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, decided to disallow the collection as evidence of the documents filed by the assessee.

With regard to the request to access information from accessible and open sources, the trial panel assessed that they can be consulted by it in the context of this trial.

Asked by the presiding judge about the final conclusion, the assessee stated that he stands by the final conclusions included in the appeal.

The court, consulted on the spot, announced the closure of the judicial review and withdrew to make the final decision of the case, to be announced on 14.07.2023, at 13.00.

The public hearing shall take place in the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
