The trial panel of the Appeal Chamber, composed of judges, Rezarta Schuetz, presiding, Sokol Çomo, rapporteur, Albana Shtylla, Ina Rama, Mimoza Tasi members, announced the decision on case (JR) no. 11/2021, dated 03.03.2021, pertaining to the appeal of the assessee Brahim Dragjoshi against decision no. 315, dated 16.11.2020 of the Independent Qualification Commission.

At the conclusion of the trial, the trial panel, pursuant to Article 4 (6) of Law No. 84/2016, “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, as well as Article 95 of the Administrative Procedures Code, unanimously decided:

– Termination of the transitional re-evaluation process for the assessee Brahim Dragjoshi without a final decision on the case, as the object and purpose of this process has become impossible.

    On 16.06.2025, the Appeal Chamber held the public hearing of case (JR) no. 43/2022, dated 27.09.2022, pertaining to the appeal of the assessee Çlirim Sino against decision no. 547, dated 06.07.2022 of the Independent Qualification Commission.

    The assessee responded to the questions of the trial panel regarding the asset assessment criteria in view of the consideration of the case and assessed as unfounded in evidence and law the IQC decision that had dismissed him from office, according to him, unfairly, without even charging him with the burden of proof. The assessee filed several documents along with the appeal, which he requested to be collected as evidence, a request dismissed by the trial panel on grounds that it fails to meet the requirements of Article 47 of Law 49/2012 “On administrative courts and adjudication of administrative disputes”, as amended.

    After the trial panel decided to close the judicial review of the case, the assessee finally requested the amendment of decision no. 547, dated 06.07.2022 of the Independent Qualification Commission, and his confirmation in office.

    After hearing the final request of the assessee, the trial panel withdrew in chambers to make the final decision, which it shall announce on 23.06.2025, at 10:00.

    The public hearing shall take place at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
