Today, on 22.07.2024, at 10:00, the Appeal Chamber held the public hearing of case (JR) 39/2023, dated 04.09.2023, pertaining to the appeal of the Public Commissioner against decision no. 661, dated 18.05.2023 of the Independent Qualification Commission, related to the assessee Besnik Hoxha.
During the submission of the final conclusions, the Public Commissioner held that during the AC proceedings, the assessee, Mr. Besnik Hoxha, failed to prove the opposite of the burden of proof regarding the asset assessment criterion as well as with regard to the ascertained circumstances of the conflict of interest, that should be evaluated by the Chamber within the proficiency assessment criterion and his integrity as a judge. Finally, the Public Commissioner requested the amendment of decision no. 661, dated 18.05.2023 of the Independent Qualification Commission, and the dismissal from office of the assessee.
The legal representative of the assessee, while objecting the appeal, stated that she stands by the arguments filed during the AC proceedings, which exhaustively prove that Mr. Besnik Hoxha reaches a reliable level in the asset assessment criterion, background assessment criterion and a qualifying score in the proficiency assessment criterion. The legal representative maintained that the assessee is no case found under conditions of conflict of interest or bias during the exercise of the office, and finally, requested the Chamber the upholding of decision no. 661, dated 18.05.2023 of the Independent Qualification Commission.
After hearing the final conclusions of the parties, the trial panel decided to close the judicial consideration of the case and withdrew in chambers to make the final decision, which it will announce on 25.07.2024, at 16:00.
The public hearing shall take place at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
