Pasi mori në shqyrtim çështjen në dhomë këshillimi, trupi gjykues, bazuar në nenin 51, pika 1, shkronja “b” e ligjit 49/2012 “Për gjykatat administrative dhe gjykimin e mosmarrëveshjeve administrative”, i ndryshuar, vendosi vijimin e gjykimit të kësaj çështjeje në seancë gjyqësore publike, për konstatimin e saktë dhe të plotë të situatës faktike që lidhet me pagimin e detyrimeve tatimore për të ardhurat e realizuara nga personi i lidhur (bashkëshorti) i subjektit të rivlerësimit.

On 17.09.2025, the Appeal Chamber held the hearing in camera of case with registration number (JR) 3/2024, dated 18.01.2024, pertaining to the appeal of the assessee Blerina Muço against decision no. 711, dated 01.11.2023 of the Independent Qualification Commission.

Following the consideration of the case in camera, the trial panel, pursuant to Article 51, paragraph 1 (b) of Law no. 49/2012 “On administrative courts and the adjudication of administrative disputes”, as amended, decided to transfer the trial of this case in a public hearing, for an accurate and complete ascertainment of the factual situation related to the payment of tax obligations for the income generated by the assessee’s related person (spouse).

The public hearing shall take place on Tuesday, 07.10.2025, at 09:30.

The Appeal Chamber held on 06.10.2025, at 13:00, the public hearing of case (JR) 55/2023, dated 24.11.2023, pertaining to the appeal of the Public Commissioner against decision no. 704, dated 09.10.2023 of the Independent Qualification Commission, related to the assessee Elidon Hysenaj.

The presiding judge announced that following the interim decision of the previous hearing, the trial panel had been directly acquainted with the classified information at the law enforcement institutions, also made known to the Independent Qualification Commission in the context of the case.

Once the parties declared that they had no other procedural requests, the trial panel decided to close the judicial investigation of the case and invited them to present their final conclusions.

The representative of the Head of the Special Prosecution Office, Mr. Klodian Braho, held that, even after being acquainted with the new evidence, the undertaking of investigative actions by the assessee in some cases remains unsubstantiated and unclear. Mr. Braho requested the Chamber to take into consideration the findings, to evaluate them in relation to the classified information with which it has become acquainted and, alternatively, to decide the amendment or the upholding of decision no. 704, dated 09.10.2023 of the Independent Qualification Commission.

The presiding judge of the trial panel requested the representative of the Head of the Special Prosecutor's Office if he could present a final and not an alternative request on the case. Mr. Braho stated that he comes with this alternative request, as he has not been acquainted with the classified information of the law enforcement agencies.

The legal representative of the assessee maintained that this alternative request of the representative of the Head of the Special Prosecution Office identified no violation of procedural or substantive law, contains no alleged violated norm, final request or argumentation based on facts.

After being consulted, the trial panel decided to request the Head of the Special Prosecution Office and his representative to submit a specific, single request, without alternatives, for the decision under consideration, inviting them, if they deem it necessary, to access for consultation in the premises of the Chamber the classified file of the assessee, administered in the IQC file, as an integral part of it.

For this reason, the public hearing was postponed to 13.10.2025, at 10:00. This hearing will be held at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.

Kolegji i Posaçëm i Apelimit zhvilloi më datë 06.10.2025, ora 13:00, seancën gjyqësore publike të çështjes (JR) 55/2023, datë 24.11.2023, që i përket ankimit të Komisionerit Publik kundër vendimit të Komisionit të Pavarur të Kualifikimit nr. 704, datë 09.10.2023, për subjektin e rivlerësimit Elidon Hysenaj.

Kryesuesja bëri me dije se, në vijim të vendimit të ndërmjetëm të seancës së mëparshme, trupi gjykues ishte njohur në mënyrë të drejtpërdrejtë me informacionin e klasifikuar, të njohur edhe nga Komisioni i Pavarur i Kualifikimit në kuadër të çështjes, pranë institucioneve ligjzbatuese.

Pasi palët deklaruan se nuk kishin kërkesa të tjera procedurale, trupi gjykues vendosi mbylljen e hetimit gjyqësor të çështjes dhe i ftoi ato në paraqitjen e konkluzioneve përfundimtare.

Përfaqësuesi i Drejtuesit të Prokurorisë së Posaçme z. Klodian Braho deklaroi se, edhe pas njohjes me provat e reja, vijon të mbetet e paargumentuar dhe e paqartë ndërmarrja e veprimeve hetimore prej subjektit të rivlerësimit në disa çështje. Z. Braho i kërkoi Kolegjit, që të marrë në konsideratë gjetjet e konstatuara, t’i vlerësojë ato në raport me informacionin e klasifikuar me të cilin është njohur dhe në mënyrë alternative të vendosë ndryshimin ose lënien në fuqi të vendimit të Komisionit të Pavarur të Kualifikimit nr. 704, datë 09.10.2023.

Kryesuesja e trupit gjykues pyeti përfaqësuesin e Drejtuesit të Prokurorisë së Posaçme nëse mund të paraqiste një kërkim përfundimtar dhe jo alternativ për çështjen. Z. Braho deklaroi se vjen me këtë kërkim alternativ, pasi nuk është njohur me informacionin e klasifikuar të agjencive ligjzbatuese.

Përfaqësuesja ligjore e subjektit të rivlerësimit deklaroi se në këtë kërkim alternativ të përfaqësuesit të Drejtuesit të Prokurorisë së Posaçme nuk identifikohet asnjë shkelje e ligjit procedural apo material, nuk ka normë të supozuar të shkelur, kërkesë përfundimtare apo argumentim të bazuar në fakte.

Pasi u konsultua, trupi gjykues vendosi t’i kërkojë Drejtuesit të Prokurorisë së Posaçme dhe përfaqësuesit të tij, të paraqesë një kërkim konkret, të vetëm, pa alternativa, për vendimin objekt kontrolli, duke i ftuar që, nëse e vlerësojnë të nevojshme, mund të aksesojnë për konsultim në ambientet e Kolegjit dosjen e klasifikuar të subjektit të rivlerësimit, e cila është e administruar në fashikullin e Komisionit, si pjesë përbërëse e tij.

Për këtë arsye, seanca publike u shty për në datën 13.10.2025, ora 10.00. Kjo seancë do të zhvillohet në ambientet e Kolegjit të Posaçëm të Apelimit, në adresën: Bulevardi “Dëshmorët e Kombit”, nr. 3, Tiranë.

The Appeal Chamber held on 24.09.2025, at 10:00, the public hearing of case (JR) 12/2024, dated 29.03.2024, pertaining to the appeal of the Public Commissioner against decision no. 736, dated 31.01.2024 of the Independent Qualification Commission, related to the assessee Gentian Habazaj.

The presiding judge announced that Article 179/b, paragraph 8 of the Constitution of the Republic of Albania and Article 199, second paragraph of the Civil Procedure Code have set forth the transfer of powers from the Public Commissioner to the Head of the Special Prosecution Office, represented in this case upon special authorization by the prosecutor of the Special Prosecution Office Mr. Adnan Xholi, present at the hearing.

During the submission of the appeal grounds related to the asset assessment criterion, the representative of the Head of the Special Prosecution Office held that the financial analysis carried out by the Independent Qualification Commission is unsupported on the acts of the case file and that the assessee has failed to convincingly prove the legitimate sources of the assets in use and the coverage of the made investments. As to the proficiency assessment criterion, Mr. Xholi stated that the reasoning of the assessee for the undertaken investigative actions remain of poor quality, lack logical and legal argumentation, and are unsubstantiated on the acts of the investigative file. The representative of the Head of the Special Prosecution Office requested the Chamber to decide the amendment of decision no. 736, dated 31.01.2024 of the Independent Qualification Commission and the dismissal from office of the assessee Gentian Habazaj.

During the submission of the objections, the assessee maintained that the appeal grounds do not stand, they are inconsistent with the evidence in the case file and that the conclusions drawn have been partially referred to the facts and documentation available. The assessee provided detailed explanations for each appeal ground related to the asset and proficiency assessment criteria and stated that the decision of the Independent Qualification Commission is fair, based on an in-depth investigation and should be upheld. In connection with the submissions, the assessee lodged some new acts, which the trial panel accepted as evidence.

Subsequently, to the purpose of the consideration of the case, the case rapporteur addressed several questions to the parties. The representative of the Head of the Special Prosecution Office stated that he would provide responses in the final conclusions, while the assessee provided explanations with their regard.

Once the parties declared that they had no other procedural requests, the trial panel decided to close the judicial investigation of the case and invited the parties to present their final conclusions. In order to give the parties time to prepare, it was decided to postpone the hearing on 14.10.2025, at 10:00.

Kolegji i Posaçëm i Apelimit zhvilloi më datë 24.09.2025, ora 10:00, seancën gjyqësore publike të çështjes (JR) 12/2024, datë 29.03.2024, që i përket ankimit të Komisionerit Publik kundër vendimit të Komisionit të Pavarur të Kualifikimit nr. 736, datë 31.01.2024, për subjektin e rivlerësimit Gentian Habazaj.

Kryesuesja e trupit gjykues bëri me dije se neni 179/b, pika 8 e Kushtetutës së Republikës së Shqipërisë dhe neni 199, paragrafi i dytë i Kodit të Procedurës Civile ka përcaktuar kalimin e kompetencave nga Komisioneri Publik tek Drejtuesi i Prokurorisë së Posaçme, i përfaqësuar në këtë çështje me autorizim të veçantë nga prokurori i Prokurorisë së Posaçme z. Adnan Xholi, i pranishëm në seancë.

Gjatë paraqitjes së shkaqeve të ankimit, lidhur me kriterin e vlerësimit të pasurisë, përfaqësuesi i Drejtuesit të Prokurorisë së Posaçme deklaroi se analiza financiare e kryer nga Komisioni i Pavarur i Kualifikimit nuk mbështetet në aktet në dosje dhe se subjekti i rivlerësimit nuk ka arritur të provojë bindshëm burimet e ligjshme të pasurisë në përdorim dhe mbulimin e investimeve të kryera. Sa i përket kriterit të vlerësimit të aftësive profesionale, z. Xholi deklaroi se arsyetimi i subjektit të rivlerësimit për veprimet hetimore të ndërmarra është i një cilësie të dobët, në të mungon argumentimi logjik dhe ligjor, si dhe nuk është i mbështetur në aktet e fashikullit hetimor. Përfaqësuesi i Drejtuesit të Prokurorisë së Posaçme i kërkoi Kolegjit të vendosë ndryshimin e vendimit të Komisionit të Pavarur të Kualifikimit nr. 736, datë 31.01.2024 dhe shkarkimin nga detyra të subjektit të rivlerësimit Gentian Habazaj.

Gjatë paraqitjes së prapësimeve, subjekti i rivlerësimit deklaroi se shkaqet e ankimit nuk qëndrojnë, ato bien ndesh me provat në dosje dhe se konkluzionet e nxjerra u janë referuar në mënyrë të pjesshme fakteve dhe dokumentacionit në dispozicion. Subjekti i rivlerësimit dha shpjegime të detajuara për secilin shkak ankimi që lidhet me kriterin e vlerësimit të pasurisë dhe atë profesional dhe deklaroi se vendimi i Komisionit të Pavarur të Kualifikimit është i drejtë, i bazuar në hetim të thelluar dhe duhet të lihet në fuqi. Bashkëlidhur parashtrimeve, subjekti i rivlerësimit depozitoi akte të reja, të cilat u pranuan në cilësinë e provës nga trupi gjykues.

Në vijim, relatorja e çështjes i drejtoi disa pyetjeve palëve në funksion të shqyrtimit të çështjes. Përfaqësuesi i Drejtuesit të Prokurorisë së Posaçme deklaroi se do t’u japë përgjigje në konkluzionet përfundimtare, ndërsa subjekti i rivlerësimit dha shpjegime rreth tyre.

Pasi palët deklaruan se nuk kishin kërkesa të tjera procedurale, trupi gjykues vendosi mbylljen e hetimti gjyqësor të çështjes dhe i ftoi ato në paraqitjen e konkluzioneve përfundimtare. Për t’u lënë kohë palëve për përgatitjen e tyre, u vendos shtyrja e seancës gjyqësore për në datën 14.10.2025, ora 10:00.

The Appeal Chamber held on 29.09.2025, at 10:00, the public hearing of case (JR) 37/2023, dated 02.08.2023, pertaining to the appeal of the Public Commissioner against decision no. 650, dated 27.04.2023 of the Independent Qualification Commission, related to the assessee Ylli Pjetërnikaj.

The presiding judge announced that Article 179/b, paragraph 8 of the Constitution of the Republic of Albania and Article 199, second paragraph, of the Civil Procedure Code have set forth the transfer of powers from the Public Commissioner to the Head of the Special Prosecution Office, represented in this case upon special authorization by the prosecutor of the Special Prosecution Office, Mr. Klodian Braho, present at the hearing.

During the submission of the appeal grounds, the representative of the Head of the Special Prosecution Office stated that the assessee has made an incorrect declaration of assets and is found in terms of financial incapacity to justify the legitimacy of the income, to such an extent that the principle of objectivity and proportionality cannot be applied. With regard to the proficiency assessment, Mr. Klodian Braho held that the assessee failed to prove the opposite of the burden of proof for the findings included in the appeal regarding the investigative actions undertaken by him. The representative of the Head of the Special Prosecution Office requested the Appeal Chamber to take into account the appeal grounds, ruling on the amendment of decision no. 650, dated 27.04.2023 of the Independent Qualification Commission and the dismissal from office of the assessee Ylli Pjetërnikaj.

The assessee objected to the appeal grounds, providing detailed explanations for each of them, whereas his legal representative stated that the essential income of the agricultural household cannot be zeroed, as long as there is no case, even suspected, of any corrupt activity of the assessee. The assessee requested the opening of the judicial investigation, accepting as evidence the acts attached to the submissions, as well as a new document lodged during today’s hearing.

As to the denunciations, the representative of the Head of the Special Prosecution Office maintained that they contain no circumstances of interest for the trial.

The assessee stated that in this context, he shares the same position as the representative of the Head of the Special Prosecution Office.

The trial panel decided to open the judicial investigation of the case, accepting as evidence all the acts filed according to the today’s hearing minutes, apart from one document, for which it provided the assessee the opportunity to lodge it in the form required by law before the subsequent hearing.

After being consulted, the trial panel decided not to investigate further the denunciations, as they fail to meet the criteria of Article 53 of Law no. 84/2016.

The trial panel decided to postpone the hearing to 15.10.2025, at 09:00, a hearing during which the parties will present their final conclusions.

The public hearing shall take place at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.

Kolegji i Posaçëm i Apelimit zhvilloi më datë 29.09.2025, ora 10:00, seancën gjyqësore publike të çështjes (JR) 37/2023, datë 02.08.2023, që i përket ankimit të Komisionerit Publik kundër vendimit të Komisionit të Pavarur të Kualifikimit nr. 650, datë 27.04.2023, për subjektin e rivlerësimit Ylli Pjetërnikaj.

Kryesuesja e trupit gjykues bëri me dije se neni 179/b, pika 8 e Kushtetutës së Republikës së Shqipërisë dhe neni 199, paragrafi i dytë i Kodit të Procedurës Civile ka përcaktuar kalimin e kompetencave nga Komisioneri Publik tek Drejtuesi i Prokurorisë së Posaçme, i përfaqësuar në këtë çështje me autorizim të veçantë nga prokurori i Prokurorisë së Posaçme z. Klodian Braho, i pranishëm në seancë.

Gjatë paraqitjes së shkaqeve të ankimit, përfaqësuesi i Drejtuesit të Prokurorisë së Posaçme deklaroi se subjekti i rivlerësimit ka kryer deklarim të pasaktë të pasurisë dhe gjendet në kushtet e pamundësisë financiare për të justifikuar ligjshmërinë e të ardhurave, në shkallë të tillë që nuk mund të gjejë zbatim parimi i objektivitetit dhe proporcionalitetit. Në kuadër të kriterit të vlerësimit të aftësive profesionale, z. Klodian Braho deklaroi se subjekti i rivlerësimit nuk arriti të provojë të kundërtën e barrës së provës për gjetjet e përfshira në ankim sa i përket veprimeve hetimore të ndërmarra prej tij. Përfaqësuesi i Drejtuesit të Prokurorisë së Posaçme i kërkoi Kolegjit të marrë në konsideratë shkaqet e ankimit, duke vendosur ndryshimin e vendimit të Komisionit të Pavarur të Kualifikimit nr. 650, datë 27.04.2023 dhe shkarkimin nga detyra të subjektit të rivlerësimit Ylli Pjetërnikaj.

Subjekti i rivlerësimit kundërshtoi shkaqet e ankimit duke dhënë shpjegime të detajuara për secilin prej tyre, ndërsa përfaqësuesja e tij ligjore deklaroi se nuk mund të zerohen të ardhurat e qenësishme të familjes bujqësore, për sa kohë nuk ekziston asnjë rast, qoftë edhe i dyshuar, i ndonjë aktiviteti korruptiv të subjektit të rivlerësimit. Subjekti i rivlerësimit kërkoi çeljen e hetimit gjyqësor, duke pranuar në cilësinë e provës aktet bashkëlidhur parashtrimeve, si dhe të një akti rë ri të depozituar gjatë seancës së sotme gjyqësore.

Lidhur me denoncimet, përfaqësuesi i Drejtuesit të Prokurorisë së Posaçme deklaroi se nuk përmbajnë ndonjë  rrethanë me interes për procesin.
Subjekti i rivlerësimit deklaroi se ndan qëndrim të njëjtë me përfaqësuesin e Drejtuesit të Prokurorisë së Posaçme në këtë kuadër.

Trupi gjykues vendosi të çelë hetimin gjyqësor të çështjes, duke pranuar në cilësinë e provës të gjitha aktet e depozituara sipas procesverbalit të seancës së sotme, përveç një akti, për të cilin, i dha mundësinë subjektit të rivlerësimit ta paraqesë në formën e kërkuar nga ligji para seancës gjyqësore pasuese.

Pasi u konsultua, trupi gjykues vendosi të mos hetojë më tej lidhur me denoncimet, pasi nuk përmbushin kriteret e nenit 53, të ligjit 84/2016.

Trupi gjykues vendosi shtyrjen e seancës gjyqësore për në datën 15.10.2025, ora 9:00, seancë, gjatë së cilës palët do të paraqesin konkluzionet përfundimtare.

Today on 29.09.2025, at 13:00, the Special Appeals Chamber held the public hearing on the case (JR) 38/2023, dated 04.09.2023, pertaining to the appeal of the Public Commissioner filed against the decision of the Independent Qualification Commission no. 673, dated 15.06.2023, rendered for the assessee Mirela Zavalani.

The presiding judge of the trial panel announced that Article 179/b, paragraph 8 of the Constitution of the Republic of Albania has dictated the transfer of powers from the Public Commissioner to the Head of the Special Prosecution Office. Pursuant to Article 199, paragraph 2 of the Civil Procedure Code, the trial panel decided to transfer the procedural proceedings from the Public Commissioner to the Head of the Special Prosecution Office, represented in this case with special authorization by the prosecutor of the Special Prosecution Office, Mr. Adnan Xholi, who was present at the hearing.

During the submission of the appeal grounds on the asset assessment criterion, the representative of the Head of the Special Prosecution Office assessed that the declarations of the assessee, Mrs. Mirela Zavalani, are unclear and contradictory in relation to the acts in the file, making her declarations unreliable, inaccurate, and making it impossible to examine the lawfulness of the sources of her assets and those of the related persons. Mr. Adnan Xholi requested the Appeals Chamber to take into consideration the appeal grounds, demanding the opening of a judicial investigation for new evidence to be received during this process, in order to reach a fair conclusion on the case.

Further on, the assessee Mrs. Mirela Zavalani and her legal representative, provided detailed explanations for each of the appeal grounds and requested the Appeals Chamber to open the judicial investigation of the case, accepting as evidence the new acts attached to the submissions, for which they stated they clarify every unclear circumstance of the administrative investigation carried out by the Independent Qualification Commission, as well as convincingly supporting the standard of reliability of the assessee in her declarations.

Following the consultation, the trial panel decided to open the judicial investigation of the case, accepting as evidence the written acts specified by the assessee in the written submissions filed as well as in the inventory of evidence attached to these submissions.

After the parties declared that they had no other procedural requests, the trial panel decided to close the judicial investigation of the case and invited the parties to present their final conclusions at the subsequent hearing scheduled to be held on 16.10.2025, at 8:30 a.m.

The public hearing shall be held at the premises of the Special Appeals Chamber, at: Bulevardi “Dëshmorët e Kombit”, nr. 3, Tirana.

Kolegji i Posaçëm i Apelimit zhvilloi më datë 29.09.2025, ora 13:00, seancën gjyqësore publike të çështjes (JR) 38/2023, datë 04.09.2023, që i përket ankimit të Komisionerit Publik kundër vendimit të Komisionit të Pavarur të Kualifikimit nr. 673, datë 15.06.2023, për subjektin e rivlerësimit Mirela Zavalani.

Kryesuesi i trupit gjykues bëri me dije se neni 179/b, pika 8 e Kushtetutës së Republikës së Shqipërisë ka përcaktuar kalimin e kompetencave nga Komisioneri Publik tek Drejtuesi i Prokurorisë së Posaçme. Bazuar në nenin 199, paragrafi i dytë i Kodit të Procedurës Civile, trupi gjykues vendosi kalimin procedural nga Komisioneri Publik tek Drejtuesi i Prokurorisë së Posaçme, i përfaqësuar në këtë çështje me autorizim të veçantë nga prokurori i Prokurorisë së Posaçme z. Adnan Xholi, i pranishëm në seancë.

Gjatë paraqitjes së shkaqeve të ankimit për kriterin e vlerësimit të pasurisë, përfaqësuesi i Drejtuesit të Prokurorisë së Posaçme vlerësoi se deklarimet e subjektit të rivlerësimit, znj. Mirela Zavalani, janë të paqarta e kontradiktore në raport me aktet në dosje, duke e bërë deklarimin e saj të pabesueshëm, të pasaktë, si dhe duke pamundësuar kontrollin e ligjshmërisë së burimeve të pasurisë së saj e personave të lidhur me të. Z. Adnan Xholi i kërkoi Kolegjit të marrë në konsideratë shkaqet e ankimit, duke disponuar çeljen e hetimit gjyqësor për të pranuar prova të reja gjatë këtij procesi, me qëllim arritjen e një konkluzioni të drejtë për çështjen.

Mirela Zavalani dhe përfaqësuesja e saj ligjore dhanë shpjegime të detajuara për secilin prej shkaqeve të ankimit dhe i kërkuan Kolegjit të çelë hetimin gjyqësor të çështjes, duke pranuar si provë aktet e reja bashkëlidhur parashtrimeve, për të cilat deklaruan se saktësojnë çdo rrethanë të paqartë të hetimit administrativ të kryer nga Komisioni i Pavarur i Kulaifikimit, si dhe mbështesin bindshëm standardin e besueshmërisë së subjektit të rivlerësimit në deklarim.

Pasi u konsultua, trupi gjykues vendosi çeljen e hetimit gjyqësor të çështjes, duke pranuar në cilësinë e provës aktet shkresore të individualizuara nga subjekti i rivlerësimit në parashtrimet me shkrim të depozituara si dhe në inventarin e provave që i bashkëlidhet këtyre parashtrimeve.

Pasi palët deklaruan se nuk kishin kërkesa të tjera procedurale, trupi gjykues vendosi mbylljen e hetimit gjyqësor të çështjes dhe i ftoi ato në paraqitjen e konkluzioneve përfundimtare në seancën e ardhshme, të datës 16.10.2025, ora 8:30.

On 02.10.2025, the Special Appeals Chamber reviewed in camera the case with registration number (JR) 31/2023, dated 17.07.2023, pertaining to the appeal of the assessee Armand Gurakuqi filed against the decision of the Independent Qualification Commission, no. 652, dated 28.04.2023.

After having reviewed the case in camera, the trial panel, pursuant to Article 51, paragraph 1, item “b” of Law 49/2012 “On Administrative Courts and the Adjudication of Administrative Disputes”, as amended, decided to continue the adjudication of this case in a public hearing, in order to accurately and completely determine the factual situation regarding the borrowing relationship between the spouse of the assessee and Mr. F. Sh., as well as the cooperation relationship between the spouse of the assessee and Mr. Z. Z., partner at the investment company “A.C.” ShPK.

The public hearing shall be held on 27.10.2025, at 11:00.

Kolegji i Posaçëm i Apelimit zhvilloi më datë 06.10.2025, ora 10:00, seancën gjyqësore publike të çështjes (JR) 42/2024, datë 28.10.2024, që i përket ankimit të Komisionerit Publik kundër vendimit të Komisionit të Pavarur të Kualifikimit nr. 779, datë 28.06.2024, për subjektin e rivlerësimit Aurel Zarka.

Kryesuesi i trupit gjykues bëri me dije se neni 179/b, pika 8 e Kushtetutës së Republikës së Shqipërisë ka përcaktuar kalimin e kompetencave nga Komisioneri Publik tek Drejtuesi i Prokurorisë së Posaçme. Bazuar në nenin 199, paragrafi i dytë i Kodit të Procedurës Civile, trupi gjykues vendosi kalimin procedural nga Komisioneri Publik tek Drejtuesi i Prokurorisë së Posaçme, i përfaqësuar në këtë çështje me autorizim të veçantë nga prokurori i Prokurorisë së Posaçme z. Adnan Xholi, i pranishëm në seancë.

Përfaqësuesi ligjor i subjektit të rivlerësimit, i autorizuar me prokurë prej tij, paraqiti një kërkesë për shtyrje të seancës me qëllim për të pritur përfundimin e gjykimit të një çështjeje penale në ngarkim të subjektit të rivlerësimit pranë Gjykatës së Posaçme të Apelit për Korrupsionin dhe Krimin e Organizuar, më datë 10.10.2025, pasi sipas tij, ky vendim do të ndikonte në qëndrimin që ata do të mbanin në çështjen në Kolegj. Pasi dëgjoi qëndrimin e përfaqësuesit të Drejtuesit të Prokurorisë së Posaçme, i cili u shpreh për vijimin e gjykimit, trupi vendosi rrëzimin e kërkesës, duke ftuar palët të vijojnë me parashtrimet.

Përfaqësuesi i Drejtuesit të Prokurorisë së Posaçme deklaroi se, bazuar në rrethanën e re, atë të procedimit penal të subjektit të rivlerësimit, i kërkoi Kolegjit riçeljen e hetimit gjyqësor të çështjes, me qëllim që t’i drejtohet institucioneve përkatëse për përditësim të informacionit për të vlerësuar nëse subjekti i rivlerësimit arrin nivel të besueshëm për konfirmimin në detyrë bazuar në të tria kriteret e vlerësimit, të pasurisë, figurës dhe profesionalizmit. Përfaqësuesi i Drejtuesit të Prokurorisë së Posaçme kërkoi në mënyrë alternative ndryshimin e vendimit të Komisionit të Pavarur të Kualifikimit nr. 779, datë 28.06.2024 ose lënien në fuqi të tij.

Përfaqësuesi ligjor i subjektit të rivlerësimit dha shpjegimet e tij lidhur me ankimin dhe la në vlerësim të Kolegjit kërkesën për t’iu drejtuar institucioneve për informacion të përditësuar, duke veçuar rastet kur ky informacion nuk do të ndikonte në çështjen objekt gjykimi. Përfaqësuesi ligjor kërkoi lënien në fuqi të vendimit të Komisionit të Pavarur të Kualifikimit nr. 779, datë 28.06.2024.

Trupi gjykues, pasi dëgjoi parashtrimet e palëve dhe kërkesën e përfaqësuesit të Drejtuesit të Prokurorisë së Posaçme, në bazë të nenit F, pika 3 e Aneksit të Kushtetutës, nenin 45 dhe 49/1 të ligjit 84/2016, vendosi:

- të riçelë hetimin gjyqësor të çështjes, duke kërkuar raportin e përditësuar nga Agjencia Kombëtare e Sigurimit të Informacionit të Klasifikuar (AKSIK), mbi kontrollin e figurës për subjektin e rivlerësimit Aurel Zarka.

- të kërkohen materialet hetimore për dy procedime penale nga Prokuroria pranë Gjykatës së Shkallës së Parë Vlorë si dhe nga Gjykata e Posaçme e Apelit kundër Korrupsionit dhe Krimit të Organizuar,

The Appeal Chamber held on 06.10.2025, at 10:00, the public hearing of case (JR) 42/2024, dated 28.10.2024, pertaining to the appeal of the Public Commissioner against decision no. 779, dated 28.06.2024 of the Independent Qualification Commission, related to the assessee Aurel Zarka.

The presiding judge announced that Article 179/b, paragraph 8 of the Constitution of the Republic of Albania has set forth the transfer of powers from the Public Commissioner to the Head of the Special Prosecution Office. Pursuant to Article 199, paragraph 2 of the Civil Procedure Code, the trial panel decided to transfer the procedural role from the Public Commissioner to the Head of the Special Prosecution Office, represented in this case upon special authorization by the prosecutor of the Special Prosecution Office, Mr. Adnan Xholi, present at the hearing.

The legal representative of the assessee, authorized upon a power of attorney, filed a request for postponement of the hearing in order to expect the conclusion of the trial of the criminal case against the assessee at the Special Court of Appeal for Corruption and Organized Crime, on 10.10.2025, since according to him, this decision would affect the position they would take in the case before the Appeal Chamber. After hearing the position of the representative of the Head of the Special Prosecution Office, who expressed his support for the continuation of the trial, the panel decided to dismiss the request, inviting the parties to continue with their submissions.

The representative of the Head of the Special Prosecution Office held that given the new circumstance, the criminal prosecution of the assessee, he requested the Chamber the reopening of the judicial investigation of the case, with the aim of addressing the relevant institutions for updating the information to assess whether the assessee reaches a reliable level for confirmation in office based on the three assessment criteria, assets, background and proficiency. The representative of the Head of the Special Prosecution Office requested, alternatively, the amendment of decision no. 779, dated 28.06.2024 of the Independent Qualification Commission or its upholding.

The legal representative of the assessee provided his explanations with respect to the appeal and left in the Chamber’s assessment the request to address the institutions for updated information, emphasizing cases when this information would not affect the case under trial. The legal representative requested the upholding of decision no. 779, dated 28.06.2024 of the Independent Qualification Commission.

The trial panel, after hearing the submissions of the parties and the request of the representative of the Head of the Special Prosecution, pursuant to Article F, paragraph 3 of the Annex to the Constitution, and Articles 45 and 49/1 of Law no. 84/2016, decided:

- to reopen the judicial investigation of the case, requesting the updated report from the National Agency of Classified Security Information (AKSIK), on the background check for the assessee Aurel Zarka.

- to request investigative materials on the two criminal proceedings to the Prosecution Office at Vlora Court of First Instance and the Special Court of Appeal against Corruption and Organized Crime.

The next public hearing shall take place on 13.11.2025, at 10:00, at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
