The Appeal Chamber held on July 15, 2019, at 13:30 h, the public hearing of case (JR) no. 36/2018, dated 04.12.2018, corresponding to the appeal of the Public Commissioner against decision no. 61 dated 02.08.2018 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Mr. Gentjan Osmani. During today’s hearing the Public Commissioner made a statement with respect to the content of the evidences, whereas the assessee stated to stand by the objections against the appeal of the Public Commissioner submitted in the previous hearing.
The adjudication panel made available to the Public Commissioner and assessee the data obtained from TIMS system and the information forwarded officially by the General Prosecution office to the Appeal Chamber upon the latter’s requests, to the purpose of investigating a denunciation. Following his acquaintance with such information, the Public Commissioner stated that the denunciation is not founded in facts, since none of its data corresponds to the officially submitted information. The assessee, on his side, stood by his request to the Chamber for conducting a financial analysis based on the submitted evidences.
The adjudication panel ruled to conduct a financial analysis to the view of the resolution of the case, considering and assessing all the evidences administered in this process. The adjudication panel decided to close the judicial investigation and invited the parties to submit their final conclusions in the hearing dated 24.07.2019, at 13.30 h. The public hearing shall be held at the premises of the Appeal Chamber, at: Bulevardi “Dëshmorët e Kombit”, nr.3. Tirana.
