Kolegji i Posaçëm i Apelimit zhvilloi më datë 28 janar 2019, ora 11.00 seancën gjyqësore publike për çështjen (JR) nr. 15/2018, datë 11.09.2018 që i përket ankimit të subjektit të rivlerësimit Artan Lazaj kundër vendimit të Komisionit të Pavarur të Kualifikimit nr. 34, datë 11.07.2018.

Gjatë seancës së sotme, subjekti i rivlerësimit paraqiti konkluzionet përfundimtare dhe i kërkoi Kolegjit të Posaçëm të Apelimit prishjen e vendimit të Komisionit të Pavarur të Kualifikimit dhe konfirmimin e tij në detyrë.

Trupi gjykues, pasi bëri shqyrtim të plotë të ankimit në seancë dëgjimore publike, mori në shqyrtim të gjithë dokumentacionin e grumbulluar nga Komisioni i Pavarur i Kualifikimit, çdo akt e provë ne lidhje me vendimin e Komisionit; pasi dëgjoi konkluzionet përfundimtare dhe zgjidhi çdo kërkesë procedurale të paraqitur nga subjekti i rivlerësimit, vendosi t’i japë fund shqyrtimit dhe të shpallë vendimin përfundimtar më datë 31 janar 2019, ora 12.00.

Seanca do të zhvillohet në ambientet e Kolegjit të Posaçëm të Apelimit, në adresën: Bulevardi “Dëshmorët e Kombit”, nr.3. Tiranë.

Today, on 28.01.2019, at 11.00 hrs., the Appeal Chamber held the public hearing of case (JR) no. 15/2018, dated 11.09.2018, corresponding to the appeal of the assessee Artan Lazaj against decision no.34, dated 11.07.2018 of the Independent Qualification Commission.

During today’s hearing the assessee submitted his final conclusions and requested the overruling of the decision of the Independent Qualification Commission and his confirmation in office.

Following the thorough review of the appeal in a public hearing, the adjudication panel reviewed the entire documentation collected by the Independent Qualification Commission, every act and evidence related to the decision of the Commission and following the hearing of the final conclusions and upon resolving every procedural request submitted by the assessee, it decided to terminate the review and announce its final decision on 31.01.2019, at 12.00 hrs.

The session shall be held at the premises of the Appeal Chamber, at: Bulevardi “Dëshmorët e Kombit”, nr.3. Tirana.

Kolegji i Posaçëm i Apelimit zhvilloi më datë 29 janar 2019, seancën gjyqësore publike të radhës për çështjen (JR) nr. 9/2018, datë 19.07.2018, që i përket ankimit të paraqitur nga Komisioneri Publik kundër vendimit nr. 22, datë 07.06.2018, të Komisionit të Pavarur të Kualifikimit që lidhet me procesin e rivlerësimit kalimtar të subjektit të rivlerësimit Edmond Islamaj.

Gjatë seancës së sotme, subjekti i rivlerësimit paraqiti informacion të detajuar për hyrje-daljet e tij nga territori i Shqipërisë dhe personave të lidhur me të, për periudhën 1 janar 2004 deri në 1 janar 2008.

Subjekti i rivlerësimit i kërkoi trupit gjykues të marrë në cilësinë e provës tri dokumente shkresore të lëshuara nga autoritetet shtetërore me kërkesë të tij.

Trupi gjykues vendosi të marrë në cilësinë e provës aktet shkresore të paraqitura nga subjekti i rivlerësimit, prova për të cilat Komisioneri Publik deklaroi se do të shprehet në konkluzionet përfundimtare.

Për t’i mundësuar Njësisë së Shërbimit Ligjor të analizojë provat e reja dhe të bëjë një rivlerësim të situatës financiare, trupi gjykues vendosi të shtyjë seancën gjyqësore ditën e martë, më datë 12.02.2019, ora 09.00.

Seanca do të zhvillohet në ambientet e Kolegjit të Posaçëm të Apelimit, në adresën: Bulevardi “Dëshmorët e Kombit”, nr.3. Tiranë.

The Appeal Chamber held today, on 29.01.2019, the next public hearing of case (JR) no.9/2018, dated 19.07.2018, corresponding to the appeal of the Public Commissioner against decision no.22, dated 07.06.2018, of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Mr. Edmond Islamaj.

During today’s hearing the assessee provided detailed information with regard to entry and exits from the territory of Albania of the assessee and persons related to him, for the time period January 1, 2004 to January 1, 2008.

The assessee requested the adjudication panel to obtain as evidences three documents issued by state authorities upon his request.

The adjudication panel decided to take as evidences the written acts submitted by the assessee. The Public Commissioner stated that he shall make a statement in this respect in his final conclusions.

In order to provide the Legal Service Unit the necessary time to analyze the new evidences and make a re-assessment of the financial situation, the panel decided to adjourn the hearing on Tuesday, on 12.02.2019, at 09.00 hrs.

Në Kolegjin e Posaçëm të Apelimit është regjistruar çështja (JR) nr.4/2019, datë 28.01.2019 që i përket ankimit të subjektit të rivlerësimit Artor Ylli kundër vendimit nr.73, datë 02.11.2018 të Komisionit të Pavarur të Kualifikimit që lidhet me procesin e rivlerësimit kalimtar të subjektit të rivlerësimit Artor Ylli.

Sot, në datën 30.01.2019, në Kolegjin e Posaçëm të Apelimit, u hodh shorti për caktimin e trupit gjykues, kryesuesin e këtij trupi dhe relatorin e çështjes.

Sot, në datën 30.01.2019, në Kolegjin e Posaçëm të Apelimit, u hodh shorti për caktimin e trupit gjykues, kryesuesin e këtij trupi dhe relatorin e çështjes.

The Appeal Chamber registered case (JR) no. 4/2019, dated 28.01.2019, corresponding to the appeal of the assessee Mr. Artor Ylli against decision no. 73, dated 02.11.2018 of the Independent Qualification Commission related to the re-evaluation of the assessee Mr. Artor Ylli.

The lot was drawn today on 30.01.2019 at the Appeal Chamber to assign the adjudication panel, the Chairperson and the Rapporteur of the case.

The Appeal Chamber held on 18.12. 2018, the public hearing of case (JR) no.13/2018, dated 07.09.2018, corresponding to the appeal of the Public Commissioner against decision no.32, dated 05.07.2018 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Ms. Alma Brati.

Upon acquaintance with the written acts submitted by the assessee, the Public Commissioner specified his request: to open the judicial investigation and in view of the investigation to re-administer the evidentiary documentation from state institutions.

Following the deliberations, the adjudication panel decided to open the judicial investigation, under Article F, paragraph 3, of the Annex to the Constitution and Article 45 of Law no. 84/2016, and administration of some documents from the state institutions with the purpose of clarification of information. Likewise, the adjudication panel decided to accept obtaining as evidence the documents submitted by the assessee.

The next hearing shall be held on 31.01.2019, at 10:00 hrs.

Trupi gjykues i Kolegjit të Posaçëm të Apelimit, i përbërë nga Sokol Çomo kryesues, Albana Shtylla relatore, Ardian Hajdari, Natasha Mulaj, Rezarta Schuetz, anëtarë, sot, më datë 31 janar 2019, ora 12.00 shpalli vendimin për çështjen (JR) nr. 15/2018, datë 11.09.2018 që i përket ankimit të subjektit të rivlerësimit Artan Lazaj kundër vendimit të Komisionit të Pavarur të Kualifikimit nr. 34, datë 11.07.2018.

Trupi gjykues vlerëson se mosshqyrtimi i kërkesës së subjektit të rivlerësimit Artan Lazaj për përjashtimin nga gjykimi i mëtejshëm i komisioneres Bekteshi nga një trup tjetër gjykues i Komisionit të Pavarur të Kualifikimit, përbën shkelje të rëndë procedurale, duke cënuar parimin e procesit të rregullt ligjor dhe atë të gjykimit nga një gjykatë e paanshme; për pasojë është i pavlefshëm. Për këto arsye, trupi gjykues vendos prishjen e vendimit nr. 34, datë 11.07.2018 të Komisionit të Pavarur të Kualifikimit.

Pavarësisht se Kolegji i Posaçëm i Apelimit e gjen vendimin nr. 34, datë 11.07.2018 të Komisionit të Pavarur të Kualifikimit të pavlefshëm dhe e prish atë, bazuar në nenin F, pika 3 të Aneksit të Kushtetutës nuk mund të kthejë për rishqyrtim në Komision çështjen e rivlerësimit të subjektit Artan Lazaj, por ka kryer vetë rivlerësimin e tij që nga momenti i konstatimit të shkeljes së rëndë procedurale gjatë zhvillimit të seancës dëgjimore në Komisionin e Pavarur të Kualifikimit.

Trupi gjykues, pasi bëri shqyrtim të plotë të ankimit në seancë gjyqësore publike, me shumicë votash, bazuar në nenet D, pikat 3 e 5 dhe F, pika 3 të Aneksit të Kushtetutës, nenet 33, 61, pika 3 dhe 66, pika 1, shkronja “c” e ligjit nr. 84/2016 “Për rivlerësimin kalimtar të gjyqtarëve dhe prokurorëve në Republikën e Shqipërisë”,

Vendosi:

1. Prishjen e vendimit nr. 34, datë 11.07.2018 të Komisionit të Pavarur të Kualifikimit, që i përket subjektit të rivlerësimit Artan Lazaj.
2. Shkarkimin nga detyra të subjektit të rivlerësimit Artan Lazaj.
3. Ky vendim është përfundimtar dhe ka efekt të menjëhershëm.

Pakica e përbërë nga gjyqtarët anëtarë Ardian Hajdari dhe Rezarta Schuetz votoi kundër vendimit, pasi ishte për lënien në fuqi të vendimit të Komisionit të Pavarur të Kualifikimit nr. 34, datë 11.07.2018.

U shpall sot, në Tiranë, më datë 31.01.2019.

Today, on 31^st of January 2019, at 12.00 h., the adjudication panel of the Appeal Chamber composed of, Chairperson Sokol Çomo, Rapporteur Albana Shtylla, and members, Ardian Hajdari, Natasha Mulaj, and Rezarta Schuetz, announced the decision of case (JR) no. 15/2018, dated 11.09.2018 corresponding to the appeal of the assessee Mr. Artan Lazaj against the Independent Qualification Commission decision no. 34, dated 11.07.2018.

The adjudication panel considers that the failure to consider the request of the assesse Artan Lazaj for the recusal of Commissioner Bekteshi from the further review of the case from another IQC adjudication panel constitutes serious procedural breach, violating the principle of due legal process and the principle of judgment by an impartial tribunal; therefore, it is invalid. For these reasons, the adjudication panel decides overruling IQC decision no. 34 dated 11.07.2018.

Regardless the fact that the Appeal Chamber finds IQC decision no. 34 dated 11.07.2018 invalid and overrules it, pursuant to Article F, paragraph 3, of the Annex to the Constitution, it cannot transfer back to the Commission the case of the re-evaluation of the assessee Artan Lazaj, but it has carried out itself the re-evaluation process since the time it found the serious procedural breach during the hearing at the Independent Qualification Commission.

The adjudication panel, following a thorough review of the appeal in a public hearing, by a majority vote, pursuant to Article D, paragraphs 3 and 5, and Article F, paragraph 3, of the Constitution, Articles 33, 61, paragraph 3, and 66, paragraph 1, item ‘c’, of Law no. 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”,

Decided:

1. Overruling decision no. 34, dated 11.07.2018 of the Independent Qualification Commission corresponding to the assessee Artan Lazaj.
2. Dismissal from office of the assessee Artan Lazaj.
3. This decision is final and has immediate effect.

The minority composed of member judges Ardian Hajdari and Rezarta Schuetz voted against the decision, as they consider that the IQC decision no. 34, dated 11.07.2018 should have been upheld.
