Trupi gjykues i Kolegjit të Posaçëm të Apelimit, i përbërë nga Sokol Çomo kryesues, Ardian Hajdari  relator, Albana Shtylla, Natasha Mulaj, Rezarta Schuetz anëtarë, shpalli sot vendimin për çështjen (JR) nr. 33/2018, datë 12.11.2018, që i përket ankimit të paraqitur nga Komisioneri Publik, kundër vendimit nr. 58, datë 01.08.2018, të Komisionit të Pavarur të Kualifikimit që lidhet me procesin e rivlerësimit kalimtar të subjektit të rivlerësimit Besnik Muçi.

Në përfundim të gjykimit, bazuar në nenin 66, pika 1, shkronja “b” e ligjit nr. 84/2016 “Për rivlerësimin kalimtar të gjyqtarëve e prokurorëve në Republikën e Shqipërisë”, trupi gjykues, në mënyrë unanime, vendosi:

• Ndryshimin e vendimit nr. 58, datë 01.08.2018, të Komisionit të Pavarur të Kualifikimit dhe shkarkimin nga detyra të subjektit të rivlerësimit Besnik Muçi, prokuror në momentin e fillimit të procesit të rivlerësimit, gjyqtar i Gjykatës Kushtetuese në momentin e shpalljes së këtij vendimi.
• Ky vendim është përfundimtar dhe ka efekt të menjëhershëm.

U shpall sot, më datë 21.11.2019, ora 11:00, në Tiranë.

The Appeal Chamber held on 12.11.2019, at 12:00 h, the public hearing of case (JR) no. 33/2018, dated 12.11.2018, corresponding to the appeal of the Public Commissioner against decision no. 58 dated 01.08.2018 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Besnik Muçi.

During today’s hearing the parties submitted their closing arguments. In line with the appeal grounds, the Public Commissioner requested the amendment of decision no. 58, dated 01.08.2018 of the Independent Qualification Commission and dismissal from office of the assessee.

The assessee submitted his objections to each appeal ground of the Public Commissioner and requested the upholding of decision no. 58, dated 01.08.2018 of the Independent Qualification Commission.

Following the final conclusions of the parties, the adjudication panel withdrew to make the final decision on the case, to be announced on 21.11.2019, at 11:00 h.

The public hearing shall be held at the premises of the Appeal Chamber, at: Bulevardi “Dëshmorët e Kombit”, nr.3. Tirana.

The adjudication panel of the Appeal Chamber, composed of judges, Chairperson Sokol Çomo, case rapporteur Ardian Hajdari, and members Albana Shtylla, Natasha Mulaj, Rezarta Schuetz, announced the decision on case (JR) no. 33/2018, dated 12.11.2018, corresponding to the appeal of the Public Commissioner against decision no. 58 dated 01.08.2018 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Besnik Muçi.

At the conclusion of the adjudication, pursuant to Article 66, paragraph 1, item ‘b’, of Law no. 84/2016 “On transitional re-evaluation of judges and prosecutors in the Republic of Albania”, the adjudication panel, unanimously decided:

1. To amend decision no. 58, dated 08.2018, of the Independent Qualification Commission and dismiss from office the assessee Besnik Muçi, prosecutor at the initiation of the re-evaluation process, judge of the Constitutional Court at the time of the announcement of this decision.
2. This decision is final and effective immediately.
