Trupi gjykues i Kolegjit të Posaçëm të Apelimit, i përbërë nga Luan Daci kryesues, Sokol Çomo relator, Ardian Hajdari, Ina Rama, Rezarta Schuetz anëtarë, vlerëson se subjekti i rivlerësimit Antoneta Sevdari ka kryer deklarim të pamjaftueshëm në kuptim të pikës 3 të nenit D, të Aneksit të Kushtetutës, nenit 33, pika 5, shkronja “b” të ligjit 84/2016, dhe se nga vlerësimi tërësor i të tre kritereve në kuptim të nenit 4, pika 2 të ligjit 84/2016, rezulton se ka cënuar besimin e publikut tek sistemi i drejtësisë.

Për këto arsye, trupi gjykues me shumicë votash, bazuar në nenet D, pika 1 dhe 3 të Aneksit të Kushtetutës, nenit 61, pika 3 dhe 5, si dhe nenit 66, pika 1, shkronja “b” të ligjit nr.84/2016 “Për rivlerësimin kalimtar të gjyqtarëve dhe prokurorëve në Republikën e Shqipërisë”,

Vendosi:

1.Ndryshimin e vendimit nr.42, datë 18.07.2018 të Komisionit të Pavarur të Kualifikimit, duke vendosur shkarkimin nga detyra të subjektit të rivlerësimit znj.Antoneta Sevdari.

2.Ky vendim është përfundimtar dhe ka efekt të menjëhershëm.

U shpall sot, në Tiranë, më datë 28.02.2019.

On February 25, 2019, the Appeal Chamber held the public hearing of case (JR) no. 17/2018, dated 13.09.2018, corresponding to the appeal of the Public Commissioner against decision no. 42, dated 18.07.2018 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Ms. Antoneta Sevdari.

During this hearing the Public Commissioner submitted his final conclusions, requesting the dismissal from office of the assessee.

The assessee considered during the submission of her final conclusions that the appeal of the Public Commissioner is not found in law and evidences proved during the IQC administrative investigation. Consequently, she requested the Appeal Chamber to uphold IQC decision no. 42 dated 18.07.2018.

The adjudication panel, following the submission of the final conclusions, decided to announce its final decision on Thursday, February 28, at 12.00 h.

The hearing shall be held at the premises of the Appeal Chamber, at: Bulevardi “Dëshmorët e Kombit”, nr.3. Tirana
