Kolegji i Posaçëm i Apelimit zhvilloi sot, më datë 5 shkurt 2019, seancën gjyqësore publike të radhës për çështjen (JR) nr.13/2018, datë 07.09.2018 që i përket ankimit të paraqitur nga Komisioneri Publik kundër vendimit nr.32, datë 05.07.2018 të Komisionit të Pavarur të Kualifikimit që lidhet me procesin e rivlerësimit kalimtar të subjektit të rivlerësimit Alma Brati.

Gjatë seancës së sotme, trupi gjykues i dorëzoi subjektit të rivlerësimit dhe Komisionerit Publik kopje të dokumenteve të lëshuara nga institucione shtetërore në vend, me kërkesë të Kolegjit të Posaçëm të Apelimit në funksion të hetimit të çështjes. Ndërkohë, trupi gjykues është ende në pritje të një dokumenti nga autoritetet tatimore italiane, kërkuar nëpërmjet Ministrisë së Drejtesisë së Republikës së Shqipërisë.

Komisioneri Publik kërkoi revokimin e vendimit për marrjen e këtij dokumenti nëpërmjet autoriteteve shtetërore italiane, duke ia lënë subjektit të rivlerësimit barrën e sjelljes së kësaj prove sipas një formulari tip të përcaktuar.

Trupi gjykues vendosi:

• të mos pranojë kërkesën e Komisionerit Publik për revokimin e vendimit për marrjen e provës nga autoritetet tatimore italiane;
• të mos pranojë kërkesën e Komisionerit Publik, në këtë moment procedural, për kalimin e barrës së provës subjektit të rivlerësimit Alma Brati;
• subjekti i rivlerësimit Alma Brati ka të drejtë të paraqesë aktet që vërtetojnë pagimin e tatimeve në Itali, nga persona të lidhur me të.

Në pritje të dokumenteve të kërkuara në cilësinë e provës, trupi gjykues shtyu seancën publike më datë 11.03.2019, ora 10.00.

Seanca do të zhvillohet në ambientet e Kolegjit të Posaçëm të Apelimit, në adresën: Bulevardi “Dëshmorët e Kombit”, nr.3. Tiranë.

On 18.12.2018 the Appeal Chamber held the public hearing of case (JR) no. 13/2018, dated 07.09.2018, corresponding to the appeal of the Public Commissioner against decision no.32, dated 05.07.2018, of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Ms. Alma Brati.

Following the acquaintance with the written acts submitted by the assessee the Public Commissioner specified his request to open the judicial investigation and re-administration of evidentiary documentation from state institutions.

Following the deliberations, the adjudication panel decided to open the judicial investigation, under Article F, paragraph 3, of the Annex to the Constitution and Article 45 of Law no. 84/2016, and administration of some documents from the state institutions to the purpose of accurateness of information. The adjudication panel decided also to accept the collection as evidences of the documents submitted by the assessee.

The next hearing shall be held on 05.02.2019, at 10:00 hrs.

The Appeal Chamber held today on the 5^th of February 2019 the consecutive hearing of case (JR) no. 13/2018, dated 07.09.2018, corresponding to the appeal of the Public Commissioner against decision no.32, dated 05.07.2018 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Ms. Alma Brati.

During today’s hearing the adjudication panel handed over to the assessee and Public Commissioner copies of documents issued by the state authorities in place upon request of the Appeal Chamber to the purpose of investigation of the case. Meanwhile, the adjudication panel is still waiting for a document from Italian tax authorities, requested through the Ministry of Justice of the Republic of Albania.

The Public Commissioner requested the revocation of the decision for the obtaining of this document from Italian state authorities, shifting to the assessee the burden of proof for the submission of this evidence as per set form.

The adjudication panel decided:

• To dismiss the request of the Public Commissioner for the revocation of the decision for the obtaining of the evidence from the Italian tax authorities;
• To dismiss the request of the Public Commissioner, at this procedural time, for the shifting of the burden of proof to the assessee Alma Brati;
• The assessee Alma Brati has the right to submit documents that prove the payment of taxes in Italy from persons related to her.

Pending the arrival of the documents required in the capacity of evidence, the adjudication panel adjourned the hearing on 11.03.2019, at 10.00 h.

The hearing shall be held at the premises of the Appeal Chamber, at: Bulevardi “Dëshmorët e Kombit”, nr.3. Tirana.
