Ditën e hënë, më datë 13.01.2020, ora 10:00, në Kolegjin  e Posaçëm të Apelimit u zhvillua seanca gjyqësore në dhomë këshillimi për shqyrtimin e çështjes me nr. (JR) regjistri 9/2019, datë 12.02.2019, që i përket ankimit të subjektit të rivlerësimit Izet Kadana kundër vendimit nr. 92, datë 20.12.2018, të Komisionit të Pavarur të Kualifikimit.

Në seancën e sotme, trupi gjykues u njoh me kërkesën për përjashtimin e gjyqtarit Luan Daci, të cilën subjekti i rivlerësimit Izet Kadana e ka paraqitur në Kolegjin e Posaçëm të Apelimit.

Pasi u njoh me kërkesën, trupi gjykues i përbërë nga Ina Rama kryesuese, Rezarta Schuetz relatore, Sokol Çomo, Luan Daci dhe Natasha Mulaj anëtarë, vendosi pezullimin e shqyrtimit gjyqësor të çështjes me nr. (JR) regjistri 9/2019, që i përket ankimit të subjektit të rivlerësimit Izet Kadana kundër vendimit nr. 92, datë 20.12.2018, të Komisionit të Pavarur të Kualifikimit, deri në shqyrtimin e kërkesës së subjektit të rivlerësimit për përjashtimin e gjyqtarit Luan Daci nga përbërja e këtij trupi gjykues.

On 13.01.2020, at 10:00 h, the Appeal Chamber reviewed in camera case (JR) no. 9/2019, dated 12.02.2019, corresponding to the appeal of the assessee Izet Kadana against decision no. 92, dated 20.12.2018 of the Independent Qualification Commission.

During today’s hearing the adjudication panel was informed of the request of the assessee Izet Kadana, filed with the Appeal Chamber, on the recusal of judge Luan Daci.

Upon acquaintance with the request, the adjudication panel composed of, Chairperson Ina Rama, judge rapporteur Rezarta Schuetz, and judge members Sokol Çomo, Luan Daci and Natasha Mulaj, decided to suspend the review of case no. (JR) register 9/2019, corresponding to the appeal of the assessee Izet Kadana against decision no. 92, dated 20.12.2018, of the Independent Qualification Commission, until the review of the request of the assessee to recuse judge Luan Daci from this panel.

Ditën e mërkurë, më datë 15.01.2020, ora 10:00, do të gjykohet në dhomë këshillimi çështja (JR) nr.8/2019, datë 12.02.2019 që i përket ankimit të paraqitur nga subjekti i rivlerësimit Admir Belishta, kundër vendimit nr. 93, datë 21.12.2018 të Komisionit të Pavarur të Kualifikimit.

Trupi gjykues i Kolegjit të Posaçëm të Apelimit, i përbërë nga Sokol Çomo kryesues, Albana Shtylla relatore, Ina Rama, Natasha Mulaj, Rezarta Schuetz anëtarë, shpalli vendimin për çështjen (JR) nr.8/2019, datë 12.02.2019, për ankimin e subjektit të rivlerësimit Admir Belishta, kundër vendimit nr. 93, datë 21.12.2018 të Komisionit të Pavarur të Kualifikimit.

Në përfundim të gjykimit në dhomë këshillimi, trupi gjykues, bazuar në nenin 66, pika 1, shkronja “a” e ligjit nr.84/2016, “Për rivlerësimin kalimtar të gjyqtarëve dhe prokurorëve në Republikën e Shqipërisë”, në mënyrë unanime, vendosi:

1. Lënien në fuqi të vendimit nr. 93, datë 21.12.2018 të Komisionit të Pavarur të Kualifikimit, që i përket subjektit të rivlerësimit Admir Belishta.
2. Ky vendim është përfundimtar dhe ka efekt të menjëhershëm.

U shpall sot, në Tiranë, më datë 15.01.2020.

The adjudication panel of the Appeal Chamber, composed of judges, Chairperson Sokol Çomo, case rapporteur Albana Shtylla, and members Ina Rama, Natasha Mulaj, Rezarta Schuetz, announced the decision on case (JR) no. 8/2019, dated 12.02.2019, corresponding to the appeal of the assessee Admir Belishta against decision no. 93, dated 21.12.2018 of the Independent Qualification Commission.

At the conclusion of the adjudication in camera, pursuant to Article 66, paragraph 1, item ‘a’, of Law no. 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, the adjudication panel, unanimously decided:

1. To uphold decision no. 93, dated 12.2018, of the Independent Qualification Commission related to the assessee Admir Belishta.
2. This decision is final and effective immediately.

The Appeal Chamber held on 16.01.2020, at 10:00 h, the public hearing of case (JR) no. 40/2018, dated 18.12.2018, corresponding to the appeal of the Public Commissioner against decision no. 63 dated 06.08.2018 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Arben Dollapaj.

The chairperson stated that besides the Ministry of Tourism and Environment the other state institutions provided responses related to the additional documentation requested by the Appeal Chamber to the purpose of review of the case.

In response to the request of the adjudication panel in the previous hearing, the Public Commissioner stated his assessment on the way the public submissions were handled. The Public Commissioner considered that he has reflected in the appeal grounds the information of a part of the submissions, whereas with regard to the rest, he stated that they do not contain sufficient grounds for further investigation by the Appeal Chamber.

In response to the appeal grounds, the assessee submitted some new additional acts, which he requested the panel to be admitted as evidences.

The adjudication panel decided to make available to the parties the responses of the state institutions, whereas it shall make available to the assessee the public submissions as well.

In order to provide the necessary time to the parties to make a statement with regard to the form and content of the materials presented in this hearing, the adjudication panel decided to interrupt the hearing and resume it on 04.02.2020, at 10:00 h.

The public hearing shall be held at the premises of the Appeal Chamber, at: Bulevardi “Dëshmorët e Kombit”, nr.3. Tirana.

Ditën e enjte, më datë 06.02.2020, ora 10:00, do të gjykohet në seancë gjyqësore publike çështja (JR) nr.13/2019, datë 27.02.2019 që i përket ankimit të paraqitur nga Komisioneri Publik kundër vendimit nr. 90, datë 20.12.2018 të Komisionit të Pavarur të Kualifikimit që lidhet me subjektin e rivlerësimit Adnand Kosova.
