Kolegji i Posaçëm i Apelimit zhvilloi sot, më datë 22.12.2020, ora 10:00, seancën gjyqësore publike të çështjes me numër regjistri (JR) 9/2020, datë 13.02.2020, që i përket ankimit të subjektit të rivlerësimit Agim Bendo kundër vendimit nr. 216, datë 04.12.2019, të Komisionit të Pavarur të Kualifikimit.

Në mungesë të subjektit të rivlerësimit, përfaqësuesi ligjor i z. Agim Bendo u dëgjua nga trupi gjykues teksa parashtroi kundërshtitë e tij ndaj pikës 2 të vendimit nr. 216, datë 04.12.2019, sipas së cilës “subjekti humb të drejtën për t’u emëruar gjyqtar ose prokuror i çdo niveli, anëtar i Këshillit të Lartë Gjyqësor ose i Këshillit të Lartë të Prokurorisë, Inspektor i Lartë Gjyqësor ose Prokuror i Përgjithshëm, për një periudhë 15-vjeçare”

Në funksion të shqyrtimit të çështjes, përfaqësuesi ligjor depozitoi dy akte, të cilat u pranuan në cilësinë e provës nga trupi gjykues.

Pasi kryesuesi i seancës deklaroi mbylljen e hetimit gjyqësor të çështjes, përfaqësuesi ligjor paraqiti kërkimin e tij përfundimtar: pasqyrimin konkretisht të shkakut real të përfundimit të detyrave të subjektit të rivlerësimit, atë të daljes në pension, si dhe, duke patur parasysh këtë shkak, ose mosaplikimin ose alternativisht, kufizimin e masës në përputhje me të drejtat që vetë ligji i jep subjektit të rivlerësimit: ushtrimin e detyrave dhe funksioneve jo përtej moshës së përcaktuar në ligj.

Në përfundim të kësaj seance, kryesuesi i trupit gjykues deklaroi shtyrjen e saj me qëllim shpalljen e vendimit përfundimtar të çështjes: ditën e sotme, më datë 22 dhjetor 2020, ora 13:45.

Seanca gjyqësore publike do të zhvillohet në ambientet e Kolegjit të Posaçëm të Apelimit, në adresën: Bulevardi “Dëshmorët e Kombit”, nr.3. Tiranë.

The Appeal Chamber held today, on 22.12.2020, at 10:00, the public hearing on the case no. (JR) 9/2020, dated 13.02.2020, corresponding to the appeal lodged by the assessee Agim Bendo against decision no. 216, dated 04.12.2019, of the Independent Qualification Commission.

Given that the assessee Mr. Agim Bendo was not present in the hearing, his legal representative was heard by the trial panel as he submitted his objections to paragraph 2 of decision no. 216, dated 04.12.2019, upon which “the assessee loses the right to be appointed a judge or prosecutor of any level, a member of the High Judicial Council or the High Prosecution Council, Senior Judicial Inspector or Prosecutor General, for a period of 15 years”.

For the purpose of the case review, the legal representative submitted two acts, which were accepted as evidence by the trial panel.

After the presiding judge declared the conclusion of the judicial investigation of the case, the legal representative stated his final request, that: be reflected clearly the real ground upon which the assessee has been dismissed from office, which is that of retirement, and based on this ground, or non-application or, alternatively, restriction of the measure in accordance with the rights that the law itself grants to the assessee: the exercise of duties and functions not beyond the defined age in the law.

At the end of this hearing, the presiding judge declared its adjournment in order to announce and deliver the final decision of the case: today, on 22 December 2020, at 13:45.

The public hearing shall be held at the premises of the Appeal Chamber, at: Bulevardi: Dëshmorët e Kombit”, nr.3. Tirana.

Trupi gjykues i Kolegjit të Posaçëm të Apelimit, i përbërë nga Ardian Hajdari kryesues, Natasha Mulaj relatore, Albana Shtylla, Rezarta Schuetz, Sokol Çomo anëtarë, shpalli vendimin për çështjen (JR) nr.9/2020, datë 13.02.2020, që lidhet me ankimin e subjektit të rivlerësimit Agim Bendo, kundër vendimit nr. 216, datë 04.12.2019 të Komisionit të Pavarur të Kualifikimit.

Në përfundim të gjykimit, trupi gjykues, bazuar në nenin G të Aneksit të Kushtetutës, nenin 66, pika 1, shkronja “a” e ligjit nr.84/2016, “Për rivlerësimin kalimtar të gjyqtarëve dhe prokurorëve në Republikën e Shqipërisë”, në mënyrë unanime, vendosi:

1. Lënien në fuqi të vendimit nr. 216, datë 04.12.2019 të Komisionit të Pavarur të Kualifikimit, që i përket subjektit të rivlerësimit Agim Bendo.
2. Ky vendim është përfundimtar dhe ka efekt të menjëhershëm.

U shpall sot, në Tiranë, më datë 22.12.2020.

The adjudication panel of the Appeal Chamber, composed of judges, Presiding Judge Ardian Hajdari, case rapporteur Natasha Mulaj and members Albana Shtylla, Rezarta Schuetz, Sokol Çomo, delivered the judgment on the case (JR) no.9/2020, dated 13.02.2020, corresponding to the appeal of the assessee Agim Bendo, against decision no. 216, dated 04.12.2019 of the Independent Qualification Commission.

In conclusion of the review, pursuant to Article G of the Annex to the Constitution, Article 66, paragraph 1, item “a”, of Law no. 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, the adjudication panel unanimously, ruled on:

1. Upholding of decision no. 216, dated 04.12.2019 of the Independent Qualification Commission, corresponding to the assessee Agim Bendo.
2. This decision is final and effective immediately.
