Kolegji i Posaçëm i Apelimit zhvilloi më datë 23.06.2020, ora 11:00, seancën gjyqësore publike për çështjen (JR) nr.44/2019, datë 18.09.2019, që i përket ankimit të paraqitur nga Komisioneri Publik, kundër vendimit nr. 162, datë 19.06.2019, të Komisionit të Pavarur të Kualifikimit që lidhet me procesin e rivlerësimit kalimtar të subjektit të rivlerësimit Manjola Kajana.

Lidhur me provat e administruara, Komisionieri Publik u shpreh se ato plotësojnë hetimin e kërkuar në shkaqet e ankimit.

Subjekti i rivlerësimit, znj. Kajana, përmes përfaqësueses ligjore, shprehu dakordësinë me përgjigjet e ardhura nga institucionet dhe provat në tërësi, por kundërshtoi si të pabazuara pretendimet e ngritura në denoncimet e ardhura në adresë të saj.

Në funksion të hetimit gjyqësor të çështjes, trupi gjykues vendosi me vendim të ndërmjetëm, t’i rikërkojë Bashkisë Fier, aplikimin e bashkëshortit të subjektit të rivlerësimit dhe dokumentet mbështetëse që kanë shërbyer si bazë për vendimin nr. 46, datë 30.10.2012 të Këshillit Bashkiak Fier, që ka miratuar listën emërore të familjeve të pastreha, pjesë e së cilës ishte dhe bashkëshorti i subjektit të rivlerësimit Manjola Kajana.

Kryesuesja e seancës bëri me dije se ky dokumentacion do t’u vendoset palëve në dispozicion në momentin e ardhjes së tij në Kolegj. Në pritje të këtij dokumentacioni, trupi gjykues vendosi të shtyjë seancën gjyqësore, gjatë së cilës do të paraqiten edhe konkluzionet përfundimtare, për në datën 02.07.2020, ora 9.00.

Seanca publike do të zhvillohet në ambientet e Kolegjit të Posaçëm të Apelimit, në adresën: Bulevardi “Dëshmorët e Kombit”, nr.3. Tiranë.

The Appeal Chamber held on 23.06.2020, at 11.00 h, the public hearing on the case (JR) no.44/2019, dated 18.09.2019 corresponding to the appeal of the Public Commissioner against decision no. 162, dated 19.06.2019 of the Independent Qualification Commission, related to the re-evaluation process of the assessee Manjola Kajana.

With regard to the administered evidence, the Public Commissioner stated that they fulfill the investigation requested in the appeal grounds.

The assessee, Mrs. Kajana, through the legal representative, expressed her agreement regarding  the replies submitted by the institutions and the evidence in general, but objected the allegations raised in the denunciations received in her address, as unfounded .

For the purpose of the judicial investigation of the case, the adjudication panel decided upon an interim decision, to request from the Municipality of Fier, the application of the assessee’s spouse and the supporting documents that have served as a basis for the decision no. 46, dated 30.10.2012 of the Municipal Council of Fier, which has approved the list of names of families with no status of abode, part of which was even the spouse of the assessee Manjola Kajana.

The Presiding judge of the hearing informed that this documentation will be made available to the parties as soon as they are delivered within the Appeal Chamber. Pending this documentation, the adjudication panel decided to adjourn the hearing, during which there will be stated the final conclusions, on 02.07.2020, at 9.00.

The public hearing shall be held at the premises of the Appeal Chamber, at: Bulevardi “Dëshmorët e Kombit”, nr.3. Tirana

Në Kolegjin e Posaçëm të Apelimit është regjistruar çështja (JR) nr.20/2020, datë 17.06.2020 që i përket ankimit të subjektit të rivlerësimit Fatri Islamaj kundër vendimit nr. 220, datë 10.12.2019 të Komisionit të Pavarur të Kualifikimit.

Sot, në datën 23.06.2020, në Kolegjin e Posaçëm të Apelimit, u hodh shorti për caktimin e trupit gjykues, kryesuesin e këtij trupi dhe relatorin e çështjes.

Trupi gjykues i caktuar me short është i përbërë si më poshtë vijon:

The Appeal Chamber has registered the case (JR) no.20/2020, dated 17.06.2020 corresponding to the appeal of the assessee Fatri Islamaj against decision no. 220, dated 10.12.2019 of the Independent Qualification Commission.

The lot was drawn today on 23.06.2020, at the Appeal Chamber to assign the adjudication panel, the Presiding Judge and the case Rapporteur.
