The Appeal Chamber held on 11.09.2020, at 10:00, the public hearing on the case (JR) no. 21/2019, dated 24.04.2019, corresponding to the appeal lodged by the Public Commissioner against decision no. 103, dated 05.02.2019, of the Independent Qualification Commission related to the transitional re-evaluation process of the assessee Donika Prela.

While verifying the presence of the litigants, the presiding judge noticed that the assessee, Donika Prela was absent and only her legal representative was present. After the adjudication panel withdrew to consult whether the representation conditions by the legal representative of the assessee were complete, the presiding judge informed the litigants regarding a statement which was recently sent electronically to the Appeal Chamber, upon which the sender, Donika Prela had stated that she would not participate in the hearing and in her absence she would be represented by lawyer Blerina Dodaj, being present.

After the litigants requested the continuation of the adjudication, based on the new evidence filed by the assessee, Mrs. Prela, her legal representative submitted her objections regarding each of the appeal grounds filed by the Public Commissioner.

The Public Commissioner stated that he was ready to submit the final conclusions during today’s hearing, while the legal representative of the assessee asked the adjudication panel for more time to submit the conclusions and she would do it after having heard the submissions of the Public Commissioner and after having consulted it with the assessee.

The adjudication panel decided to conclude the judicial investigation of the case and deemed the request of the legal representative of the assessee for the submission of the final conclusions after having heard the conclusions of the Public Commissioner, as ungrounded.

The adjudication panel deemed that the conclusions of the Public Commissioner and those of the assessee should be submitted within the same hearing. Upon this reason, the adjudication panel decided to adjourn the hearing on 18.09.2020, at 9.00.

The public hearing shall be held at the premises of the Appeal Chamber, at: Bulevardi “Dëshmorët e Kombit”, nr.3. Tirana.

Kolegji i Posaçëm i Apelimit zhvilloi më datë 11.09.2020, ora 10:00, seancën gjyqësore publike për çështjen (JR) nr. 21/2019, datë 24.04.2019, që i përket ankimit të paraqitur nga Komisioneri Publik kundër vendimit nr. 103, datë 05.02.2019, të Komisionit të Pavarur të Kualifikimit që lidhet me procesin e rivlerësimit kalimtar të subjektit të rivlerësimit Donika Prela.

Gjatë verifikimit të prezencës së palëve, kryesuesja e seancës konstatoi mungesën e subjektit të rivlerësimit, Donika Prela dhe prezencën vetëm të përfaqësueses ligjore të saj. Pasi trupi gjykues u tërhoq për t’u konsultuar nëse kushtet e përfaqësimit të subjektit të rivlerësimit nga përfaqësuesja e saj ligjore ishin të plota, kryesuesja e seancës njohu palët me një deklaratë të mbërritur rishtas në Kolegj në mënyrë elektronike, nëpërmjet së cilës, dërguesja, Donika Prela shprehej që nuk do të merrte pjesë në séance dhe se do të përfaqësohej nga avokate Blerina Dodaj, në prezencë dhe në mungesë të saj.

Pasi palët kërkuan vazhdimin e gjykimit, duke u bazuar tek provat e reja të depozituara nga subjekti i rivlerësimit znj. Prela, përfaqësuesja e saj ligjore paraqiti prapësimet lidhur me secilin prej shkaqeve të ankimit të Komisionerit Publik.

Komisioneri Publik shprehu gadishmërinë e tij për të paraqitur konkluzionet përfundimtare gjatë seancës së sotme gjyqësore, ndërsa përfaqësuesja ligjore e subjektit të rivlerësimit i kërkoi kohë shtesë trupit gjykues, për t’i paraqitur konkluzionet pasi të dëgjojë Komisionerin Publik dhe pasi të konsultohet me subjektin e rivlerësimit.

Trupi gjykues vendosi mbylljen e hetimit gjyqësor të çështjes dhe vlerësoi si të pabazuar kërkesën e përfaqësueses ligjore të subjektit të rivlerësimit për të paraqitur konkluzionet përfundimtare, pasi të dëgjojë konkluzionet e Komisionerit Publik.

Trupi gjykues vlerësoi që konkluzionet e Komisionerit Publik dhe të subjektit të rivlerësimit duhet të paraqiten në të njëjtën seancë. Për këtë arsye, vendosi të shtyjë seancën gjyqësore për në datën 18.09.2020, ora 9.00.

Seanca publike do të zhvillohet në ambientet e Kolegjit të Posaçëm të Apelimit, në adresën: Bulevardi “Dëshmorët e Kombit”, nr.3. Tiranë.

Ditën e hënë, më datë 12.10.2020, ora 10:00, do të gjykohet në dhomë këshillimi çështja (JR) nr.42/2019, datë 17.09.2019 që i përket ankimit të paraqitur nga subjekti i rivlerësimit Fuat Vjerdha, kundër vendimit nr. 155, datë 10.06.2019 të Komisionit të Pavarur të Kualifikimit.
