Kolegji i Posaçëm i Apelimit zhvilloi sot, më datë 21.06.2021, ora 10:00, seancën gjyqësore publike të çështjes që i përket ankimit të Komisionerit Publik kundër vendimit nr. 200, datë 16.10.2019, të Komisionit të Pavarur të Kualifikimit që lidhet me subjektin e rivlerësimit Besim Hajdarmataj [(JR) 3/2020, datë 14.01.2020].

Komisioneri Publik paraqiti shkaqet e ankimit lidhur me dy kriteret e vlerësimit të subjektit të rivlerësimit: atë të aftësive profesionale dhe kriterin e pasurisë, si dhe vlerësimin tërësor të çështjes, duke i kërkuar Kolegjit ndryshimin e vendimit të Komisionit të Pavarur të Kualifikimit objekt ankimi dhe shkarkimin nga detyra të subjektit të rivlerësimit.

Subjekti i rivlerësimit dhe përfaqësuesja e tij ligjore kundërshtuan shkaqet e ankimit të Komisionerit Publik, duke pretenduar se janë joobjektive, jo proporcionale, të pabazuara në ligj, në prova apo në rrethanat e çështjes. Në mbështetje të këtyre pretendimeve, përveç disa akteve të depozituara në Kolegj më datë 15.06.2021 – të cilat i ishin përcjellë paraprakisht Komisionerit Publik – subjekti i rivlerësimit depozitoi akte të reja bashkëlidhur parashtrimit të sotëm, duke kërkuar riçeljen e hetimit gjyqësor të çështjes.

Me kërkesë të kryesueses së seancës, Komisioneri Publik u shpreh për denoncimet e ardhura në adresë të subjektit të rivlerësimit, z. Hajdarmataj, duke vlerësuar se në to nuk gjenden rrethana për t’i përfshirë në shkaqet e ankimit.

Për t’i lënë kohë të mjaftueshme Komisionerit Publik të shprehet lidhur me aktet e depozituara nga subjekti i rivlerësimit, trupi gjykues vendosi të shtyjë seancën gjyqësore publike për në datën 06.07.2021, ora 12:00.

Seanca gjyqësore publike do të zhvillohet në ambientet e Kolegjit të Posaçëm të Apelimit, në adresën Bulevardi “Dëshmorët e Kombit”, nr.3. Tiranë.

Today, on 21.06.2021, at 10:00, the Appeal Chamber held the public hearing of the case (JR) no. 3/2020, dated 14.01.2020 corresponding to the appeal of the Public Commissioner filed against decision no. 200, dated 16.10.2019, of the Independent Qualification Commission related to the assessee Besim Hajdarmataj.

The Public Commissioner submitted the appeal grounds regarding the two re-evaluation criteria for the assessee: the proficiency and the asset assessment criteria, as well as the overall evaluation on the case, asking the Appeal Chamber to amend the decision of the Independent Qualification Commission subject to review and dismissal of the assessee.

The assessee and his legal representative objected the appeal grounds filed by the Public Commissioner, claiming that they were non-objective, disproportionate, unfounded in law, in evidence or the circumstances of the case. In support of these claims, in addition to some acts filed with the Appeal Chamber on 15.06.2021 – which were forwarded in advance to the Public Commissioner – the assessee filed new acts attached to objections submitted in today’s hearing, by requesting the reopening of the judicial investigation of the case.

At the request of the presiding judge, the Public Commissioner stated his position regarding the denunciations filed in the name of the assessee, Mr. Hajdarmataj, by deeming that they contain no circumstances that should be included in the appeal grounds.

In order for the Public Commissioner to have the appropriate time to comment on the acts filed by the assessee, the trial panel decided to adjourn the public hearing on 06.07.2021, at 12:00.

The public hearing shall take place at the premises of the Appeal Chamber, at: Bulevardi “Dëshmorët e Kombit”, nr.3. Tirana.
