The Appeal Chamber held on July 11, 2019, at 10:00 h, the public hearing of case (JR) no. 36/2018, dated 04.12.2018, corresponding to the appeal of the Public Commissioner against decision no. 61 dated 02.08.2018 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Mr. Gentjan Osmani.
During today’s hearing the Public Commissioner submitted the appeal grounds, whereas the assessee submitted his objections to the appeal of the Public Commissioner and requested the adjudication panel to open the judicial review of the case and administer in the capacity of evidence a few new acts lodged by him during today’s hearing. The Public Commissioner requested the adjudication panel to take into consideration a new denunciation on the account of the assessee that the International Monitoring Operation has forwarded to the Public Commissioner and the latter included in the appeal grounds. Upon request of the case rapporteur, the Public Commissioner clarified the main elements of the denunciation, which the Chamber is requested to conduct a thorough investigation.
The adjudication panel, having withdrawn for decision-making, ruled to open the judicial investigation for the adjudication of the case and allow the collection as evidence of the acts filed by the assessee during today’s hearing. Also, in response to the requests for investigation of the Public Commissioner, to the purpose of investigation on this denunciation, the adjudication panel decided to request information from the General Prosecution office and data from TIMS system. As per above and to provide the necessary time to the Public Commissioner to make a statement with regard to the content of the evidences, the adjudication panel decided to adjourn the hearing on 15.07.2019, at 13:30 h. The public hearing shall be held at the premises of the Appeal Chamber, at: Bulevardi “Dëshmorët e Kombit”, nr.3. Tirana.
