Today, on 31st of January 2019, at 12.00 h., the adjudication panel of the Appeal Chamber composed of, Chairperson Sokol Çomo, Rapporteur Albana Shtylla, and members, Ardian Hajdari, Natasha Mulaj, and Rezarta Schuetz, announced the decision of case (JR) no. 15/2018, dated 11.09.2018 corresponding to the appeal of the assessee Mr. Artan Lazaj against the Independent Qualification Commission decision no. 34, dated 11.07.2018.

The adjudication panel considers that the failure to consider the request of the assesse Artan Lazaj for the recusal of Commissioner Bekteshi from the further review of the case from another IQC adjudication panel constitutes serious procedural breach, violating the principle of due legal process and the principle of judgment by an impartial tribunal; therefore, it is invalid. For these reasons, the adjudication panel decides overruling IQC decision no. 34 dated 11.07.2018.

Regardless the fact that the Appeal Chamber finds IQC decision no. 34 dated 11.07.2018 invalid and overrules it, pursuant to Article F, paragraph 3, of the Annex to the Constitution, it cannot transfer back to the Commission the case of the re-evaluation of the assessee Artan Lazaj, but it has carried out itself the re-evaluation process since the time it found the serious procedural breach during the hearing at the Independent Qualification Commission.

The adjudication panel, following a thorough review of the appeal in a public hearing, by a majority vote, pursuant to Article D, paragraphs 3 and 5, and Article F, paragraph 3, of the Constitution, Articles 33, 61, paragraph 3, and 66, paragraph 1, item ‘c’, of Law no. 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”,

Decided:

  1. Overruling decision no. 34, dated 11.07.2018 of the Independent Qualification Commission corresponding to the assessee Artan Lazaj.
  2. Dismissal from office of the assessee Artan Lazaj.
  3. This decision is final and has immediate effect.

The minority composed of member judges Ardian Hajdari and Rezarta Schuetz voted against the decision, as they consider that the IQC decision no. 34, dated 11.07.2018 should have been upheld.

Klodjan Braho deklaroi se është njohur në mënyrë të drejtëpërdrejtë me informacionin e klasifikuar pranë organit ligjzbatues, në funksion të përgatitjes së një kërkimi përfundimtar të qartë e objektiv për çështjen nën shqyrtim.

    Pasi u konsultua, trupi gjykues vendosi mbylljen e hetimit gjyqësor të çështjes dhe kryesuesja e seancës ftoi palët në paraqitjen e konkluzioneve përfundimtare.

    Drejtuesi i Prokurorisë së Posaçme z. Klodjan Braho deklaroi se pas njohjes me informacionin e klasifikuar pranë organit ligjzbatues, vlerëson se, me shpjegimet shtesë bindëse e të pranueshme në parashtrime si dhe pas vlerësimit të provave të paraqitura gjatë procesit gjyqësor të zhvilluar në Kolegj, subjekti i rivlerësimit arriti të shërojë shkaqet e ankimit. Përfundimisht, Drejtuesi i Prokurorisë së Posaçme z. Klodjan Braho Kërkoi lënien në fuqi të vendimit të Komisionit të Pavarur të Kualifikimit nr. 682, datë 10.07.2023, që lidhet me subjektin e rivlerësimit Enklid Gjini.

    Të njëjtin qëndrim përfundimtar me Drejtuesin e Prokurorisë së Posaçme ndau edhe subjekti i rivlerësimit.

    Pasi dëgjoi kërkimet përfundimtare të palëve, trupi gjykues vendosi mbylljen e shqyrtimit gjyqësor dhe u tërhoq në dhomë këshillimi për marrjen e vendimit përfundimtar, të cilin do ta shpallë më datë 15.01.2026, ora 15:00.

    Seanca publike do të zhvillohet në ambientet e Kolegjit të Posaçëm të Apelimit, në adresën: Bulevardi “Dëshmorët e Kombit”, nr. 3, Tiranë.

    The Appeal Chamber held on 12.01.2026, at 10:00, the public hearing of case (JR) 45/2023, dated 12.10.2023, pertaining to the appeal of the Public Commissioner against decision no. 682, dated 10.07.2023 of the Independent Qualification Commission, related to the assessee Enklid Gjini.

    Following the previous hearing, the Head of the Special Prosecution Office, Mr. Klodjan Braho, stated that he had been directly acquainted with the classified information at the law enforcement agency, in order to prepare a clear and objective final investigation into the case under review.

    After being consulted, the panel decided to close the judicial investigation of the case and the presiding judge invited the parties to present their final conclusions.

    The Head of the Special Prosecution Office, Mr. Klodjan Braho, stated that after being acquainted with the classified information provided by the law enforcement agency, he assessed that, considering the additional convincing and acceptable explanations in the submissions and after evaluating the evidence lodged during the judicial proceedings at the Appeal Chamber, the assessee managed to dismiss the appeal grounds. Finally, the Head of the Special Prosecution Office, Mr. Klodjan Braho, requested the upholding of decision no. 682, dated 10.07.2023 of the Independent Qualification Commission, related to the assessee Enklid Gjini.

    The assessee shared the same final position with the Head of the Special Prosecution Office.

    After hearing the final arguments of the parties, the trial panel decided to close the trial and withdrew in chambers to make the final decision, which it shall announce on 15.01.2026, at 15:00.

    The public hearing shall take place at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
