The adjudication panel of the Appeal Chamber, chaired by Ms. Albana Shtylla, case rapporteur Mr. Luan Daci and members, Mr. Ardian Hajdari, Ms. Rezarta Schuetz, and Mr. Sokol Çomo, announced today the decision of case (JR) No. 20/2018 dated 17.10.2018, corresponding to the appeal of the assessee Rovena Gashi against decision no. 48, dated 25.07.2018 of the Independent Qualification Commission.

At the beginning of the hearing, to the purpose of public transparency, judge Albana Shtylla pointed out that the assessee had filed a request demanding the recusal of the members of the adjudication panel, registered with the Appeal Chamber upon no. prot. 753/37, dated 10.05.2019.

The request of the assessee was filed after the closing of the judicial review at the hearing dated May 6, 2019, when the adjudication panel was withdrawn in chambers to deliberate on the decision-making. This request was considered by 5 adjudication panels drawn by lot in the Appeal Chamber, considering the application of the principle of proportionality of impartiality at trial with the exercising of the functions of the Appeal Chamber as a court, given its limited number of judges.

Also, with regard to the review of this request of the assessee, the Appeal Chamber, pursuant to Article 75 of the Civil Procedure Code, guaranteed its trial of 5 adjudication panels, where the judge whose recusal was requested was not a member therein.

The adjudication panels assigned by lot with regard to this request, upon decisions no. 20/6, 20/11, 20/12, 20/13 and 20/14, dated 27.05.2019, decided the dismissal of the request of the assessee Rovena Gashi for the recusal of the members of the adjudication panel reviewing the appeal against IQC decision no. 48, dated 25. 07. 2018.

Based on the afore-mentioned decisions, the adjudication panel proceeded with the deliberations on making the decision related to the assessee Rovena Gashi, and decided the following:

The adjudication panel considers that, from the financial analysis, it results that the assessee lacked payment capacity upon income from lawful financial sources, as concluded in the decision of the Independent Qualification Commission, a factual situation provided for in Article D, paragraphs 1 and 3, of the Annex to the Constitution and Article 33, paragraph 5, item ‘b’, of Law no. 84/2016.

For these reasons, pursuant to Article 66, paragraph 1, item ‘a’ of Law no. 84/2016, “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, the adjudication panel of the Appeal Chamber unanimously decided:

1. To uphold decision no. 48, dated 25.07.2018, of the Independent Qualification Commission.

2. This decision is final and effective immediately.

    Kolegji i Posaçëm i Apelimit zhvilloi më datë 25.11.2025, ora 11:00, seancën gjyqësore publike të çështjes (JR) 47/2023, datë 19.10.2023, që i përket ankimit të Komisionerit Publik kundër vendimit të Komisionit të Pavarur të Kualifikimit nr. 689, datë 24.07.2023, që lidhet me subjektin e rivlerësimit Ervin Pollozhani.

    Gjatë paraqitjes së konkluzioneve përfundimtare, përfaqësuesi i Drejtuesit të Prokurorisë së Posaçme z. Klodjan Braho deklaroi se subjekti i rivlerësimit gjendet në kushtet e deklarimit të pasaktë e të pamjaftueshëm të pasurisë dhe se pretendimet e tij për të kundërtën e shkaqeve të ankimit mbeten në nivel deklarativ e të pambështetura në aktet në dosje. Përfaqësuesi i Drejtuesit të Prokurorisë së Posaçme i kërkoi përfundimisht Kolegjit ndryshimin e vendimit nr. 689, datë 24.07.2023 të Komisionit të Pavarur të Kualifikimit dhe shkarkimin nga detyra të subjektit të rivlerësimit Ervin Pollozhani.

    Subjekti i rivlerësimit kundërshoi shkaqet e ankimit dhe dokumentin “gjetje dhe mendim” të paraqitur nga vëzhguesi ndërkombëtar i Operacionit Ndërkombëtar të Monitorimit dhe i kërkoi përfundimisht Kolegjit lënien në fuqi të vendimit nr. 689, datë 24.07.2023 të Komisionit të Pavarur të Kualifikimit, sipas tij, i bazuar në ligj e në prova, i marrë pas një hetimi të plotë, shterues dhe argumentues.

    Pasi dëgjoi konkluzionet përfundimtare të palëve, trupi gjykues vendosi mbylljen e shqyrtimit gjyqësor të çështjes dhe u tërhoq në dhomë këshillimi për marrjen e vendimit përfundimtar, të cilin do ta shpallë më datë 15.12.2025, ora 15:00.

    Seanca publike do të zhvillohet në ambientet e Kolegjit të Posaçëm të Apelimit, në adresën: Bulevardi “Dëshmorët e Kombit”, nr. 3, Tiranë.

    The Appeal Chamber held on 25.11.2025, at 11:00, the public hearing of case (JR) 47/2023, dated 19.10.2023, pertaining to the appeal of the Public Commissioner against decision no. 689, dated 24.07.2023 of the Independent Qualification Commission, related to the assessee Ervin Pollozhani.

    During the submission of the final conclusions, the representative of the Head of the Special Prosecution Office, Mr. Klodjan Braho stated that the assessee is found in terms of incorrect and insufficient declaration of assets and that his claims to the contrary of the appeal grounds remain at a declarative level and unsupported by the acts of the case file. The representative of the Head of the Special Prosecution Office ultimately requested the Appeal Chamber the amendment of decision no. 689, dated 24.07.2023 of the Independent Qualification Commission and the dismissal from office of the assessee Ervin Pollozhani.

    The assessee disputed the appeal grounds and the document “findings and opinion” submitted by the International Observer of the International Monitoring Operation and finally requested the Chamber the upholding of decision no. 689, dated 24.07.2023 of the Independent Qualification Commission, which according to him, is supported on law and evidence, following a complete, exhaustive and argumentative investigation.

    After hearing the final conclusions of the parties, the trial panel decided to close the judicial review of the case and withdrew in chambers to make the final decision, which it shall announce on 15.12.2025, at 15:00.

    The public hearing shall take place at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
