The adjudication panel of the Appeal Chamber, composed of judges, Presiding Judge Luan Daci, case rapporteur Albana Shtylla, and members Ardian Hajdari, Ina Rama, Natasha Mulaj, announced the decision on case (JR) no. 16/2019, dated 01.04.2019, corresponding to the appeal of the assessee Arben Zefi, against decision no. 97, dated 10.01.2019 of the Independent Qualification Commission.

At the conclusion of the adjudication  in camera, pursuant to Article 66, paragraph 1, item “a” of Law no. 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, the adjudication panel, unanimously, decided:

  1. Upholding of decision no. 97, dated 10.01.2019 of the Independent Qualification Commission, related to assessee Arben Zefi.
  2. This decision is final and effective immediately.

Announced in Tirana, today, on 01.07.2020.

    Trupi gjykues i Kolegjit të Posaçëm të Apelimit, i përbërë nga Natasha Mulaj kryesuese, Mimoza Tasi relatore, Albana Shtylla, Rezarta Schuetz, Sokol Çomo anëtarë, shpalli vendimin për çështjen nr. 45/2023, datë 12.10.2023, që i përket ankimit të Komisionerit Publik kundër vendimit të Komisionit të Pavarur të Kualifikimit, nr. 682, datë 10.07.2023, që lidhet me subjektin e rivlerësimit Enklid Gjini.

    Në përfundim të gjykimit, trupi gjykues, bazuar në nenin 4, pika 6 të ligjit nr. 84/2016, “Për rivlerësimin kalimtar të gjyqtarëve dhe prokurorëve në Republikën e Shqipërisë”, dhe në nenet 451, shkronja “b” e 463 të Kodit të Procedurës Civile, me shumicë votash, vendosi:

    Pushimin e shqyrtimit të çështjes (JR) nr. 45, datë 12.10.2023, për ankimin e Komisionerit Publik kundër vendimit nr. 682, datë 10.07.2023, të Komisionit të Pavarur të Kualifikimit, që i përket subjektit të rivlerësimit Enklid Gjini.

    Ky vendim është përfundimtar dhe ka efekt të menjëhershëm.

    U shpall sot, më datë 15.01.2026, në Tiranë.

    The Appeal Chamber held on 12.01.2026, at 10:00, the public hearing of case (JR) 45/2023, dated 12.10.2023, pertaining to the appeal of the Public Commissioner against decision no. 682, dated 10.07.2023 of the Independent Qualification Commission, related to the assessee Enklid Gjini.

    Following the previous hearing, the Head of the Special Prosecution Office, Mr. Klodjan Braho, stated that he had been directly acquainted with the classified information at the law enforcement agency, in order to prepare a clear and objective final investigation into the case under review.

    After being consulted, the panel decided to close the judicial investigation of the case and the presiding judge invited the parties to present their final conclusions.

    The Head of the Special Prosecution Office, Mr. Klodjan Braho, stated that after being acquainted with the classified information provided by the law enforcement agency, he assessed that, considering the additional convincing and acceptable explanations in the submissions and after evaluating the evidence lodged during the judicial proceedings at the Appeal Chamber, the assessee managed to dismiss the appeal grounds. Finally, the Head of the Special Prosecution Office, Mr. Klodjan Braho, requested the upholding of decision no. 682, dated 10.07.2023 of the Independent Qualification Commission, related to the assessee Enklid Gjini.

    The assessee shared the same final position with the Head of the Special Prosecution Office.

    After hearing the final arguments of the parties, the trial panel decided to close the trial and withdrew in chambers to make the final decision, which it shall announce on 15.01.2026, at 15:00.

    The public hearing shall take place at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
