The Appeal Chamber held on 18.06.2025, at 10:00, the public hearing of case (JR) 8/2023, dated 24.02.2023, pertaining to the appeal of the Public Commissioner against decision no. 600, dated 19.12.2022 of the Independent Qualification Commission, related to the assessee Robert Kote.

The presiding judge informed the parties that following the previous hearing, the assessee had submitted with the AC the summary decision of the Court of Appeal of General Jurisdiction, which was also forwarded to the representative of the Special Prosecution Office for evaluation purposes in the final conclusions.

Once the parties declared that they had no other procedural requests, the trial panel decided to close the judicial investigation and invited them to submit their final conclusions.

The representative of the Special Prosecution office, Mr. Klodian Braho, in reference to the new evidence lodged by the assessee during the AC proceedings, stated that his financial insufficiency is to such an extent that it does not violate the reliability with respect to the asset assessment criteria. According to Mr. Braho, as to the proficiency assessment and findings related to criminal proceedings handled by the assessee during the exercise of his office, it was proven that no deficiencies were found that could violate the public trust in the justice system. Finally, the representative of the Special Prosecution Office requested the upholding of decision no. 600, dated 19.12.2022 of the Independent Qualification Commission.

The assessee stated that, through the new evidence submitted during this proceedings, he managed to prove the opposite of the appeal, and finally requested the upholding of decision no. 600, dated 19.12.2022 of the Independent Qualification Commission and his confirmation in office.

After hearing the final conclusions of the parties, the trial panel decided to close the judicial review of the case and withdrew in chambers to make the final decision, which it shall announce on 03.07.2025, at 15:00.

The public hearing shall take place at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.

    Kolegji i Posaçëm i Apelimit zhvilloi më datë 16.06.2025, seancën gjyqësore publike të çështjes me numër regjistri (JR) 43/2022, datë 27.09.2022, që i përket ankimit të subjektit të rivlerësimit Çlirim Sino kundër vendimit të Komisionit të Pavarur të Kualifikimit, nr. 547, datë 06.07.2022.

    Subjekti i rivlerësimit iu përgjigj pyetjeve të trupit gjykues lidhur me kriterin e vlerësimit të pasurisë në funksion të shqyrtimit të çështjes dhe vlerësoi si të pabazuar në prova e ligj vendimin e Komisionit të Pavarur të Kualifikimit që e pati shkarkuar nga detyra, sipas tij, në mënyrë të padrejtë, duke mos i ngarkuar as barrë prove. Bashkëlidhur ankimit, subjekti i rivlerësimit kishte depozituar disa akte, të cilat kërkoi të merren në cilësinë e provës, kërkesë kjo që nuk u pranua nga trupi gjykues me arsyetimin se nuk plotëson kërkesat e nenit 47 të ligjit 49/2012 "Për gjykatat administrative dhe gjykimin e mosmarrëveshjeve administrative", i ndryshuar.

    Pasi trupi gjykues vendosi mbylljen e shqyrtimit gjyqësor të çështjes, subjekti i rivlerësimit kërkoi përfundimisht ndryshimin e vendimit të Komisionit të Pavarur të Kualifikimit, nr. 547, datë 06.07.2022 dhe konfirmimin e tij në detyrë.

    Pasi dëgjoi kërkimin përfundimtar të subjektit të rivleresimit, trupi gjykues u tërhoq në dhomë këshillimi për marrjen e vendimit përfundimtar, të cilin do ta shpallë më datë 23.06.2025, ora 10:00.

    Seanca gjyqësore publike do të zhvillohet në ambientet e Kolegjit të Posaçëm të Apelimit, në adresën: Bulevardi “Dëshmorët e Kombit”, nr.3. Tiranë.

    On 16.06.2025, the Appeal Chamber held the public hearing of case (JR) no. 43/2022, dated 27.09.2022, pertaining to the appeal of the assessee Çlirim Sino against decision no. 547, dated 06.07.2022 of the Independent Qualification Commission.

    The assessee responded to the questions of the trial panel regarding the asset assessment criteria in view of the consideration of the case and assessed as unfounded in evidence and law the IQC decision that had dismissed him from office, according to him, unfairly, without even charging him with the burden of proof. The assessee filed several documents along with the appeal, which he requested to be collected as evidence, a request dismissed by the trial panel on grounds that it fails to meet the requirements of Article 47 of Law 49/2012 “On administrative courts and adjudication of administrative disputes”, as amended.

    After the trial panel decided to close the judicial review of the case, the assessee finally requested the amendment of decision no. 547, dated 06.07.2022 of the Independent Qualification Commission, and his confirmation in office.

    After hearing the final request of the assessee, the trial panel withdrew in chambers to make the final decision, which it shall announce on 23.06.2025, at 10:00.

    The public hearing shall take place at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.

    Kolegji i Posaçëm i Apelimit zhvilloi më datë 18.06.2025, ora 10:00, seancën gjyqësore publike të çështjes (JR) 8/2023, datë 24.02.2023, që i përket ankimit të Komisionerit Publik kundër vendimit të Komisionit të Pavarur të Kualifikimit nr. 600, datë 19.12.2022, që lidhet me subjektin e rivlerësimit Robert Kote.

    Kryesuesja informoi se, në vijim të seancës së mëparshme, subjekti i rivlerësimit kishte paraqitur në Kolegj vendimin e shkurtuar të Gjykatës së Apelit të Juridiksionit të Përgjithshëm, i cili i ishte përcjellë edhe përfaqësuesit të Prokurorisë së Posaçme për qëllime vlerësimi në konkluzionet përfundimtare.

    Pasi palët deklaruan se nuk kishin kërkesa të tjera procedurale, trupi gjykues vendosi mbylljen e hetimit gjyqësor dhe i ftoi ato në paraqitjen e konkluzioneve përfundimtare.

    Përfaqësuesi i Prokurorisë së Posaçme, z. Klodian Braho, në referencë të provave të reja të depozituara nga subjekti i rivlerësimit gjatë procesit të zhvilluar në Kolegj, deklaroi se pamjaftueshmëria financiare e tij është e tillë që nuk e cenon besueshmërinë lidhur me kriterit të vlerësimit të pasurisë. Sipas z. Braho, sa i përket vlerësimit të aftësive profesionale dhe gjetjeve të lidhura me procedime penale të trajtuara nga subjekti i rivlerësimit gjatë ushtrimit të detyrës, u provua se nuk konstatohen mangësi që do të mund të cenonin besimin e publikut tek sistemi i drejtësisë. Përfundimisht, përfaqësuesi i Prokurorisë së Posaçme kërkoi lënien në fuqi të vendimit të Komisionit të Pavarur të Kualifikimit nr. 600, datë 19.12.2022.

    Subjekti i rivlerësimit deklaroi se, gjatë këij procesi, arriti të provojë të kundërtën e ankimit nëpërmjet provave të reja të depozituara e kërkoi përfundimisht, lënien në fuqi të vendimit të Komisionit të Pavarur të Kualifikimit nr. 600, datë 19.12.2022 dhe konfirmimin në detyrë.

    Pasi dëgjoi konkluzionet përfundimtare të palëve, trupi gjykues vendosi mbylljen e shqyrtimit gjyqësor të çështjes dhe u tërhoq në dhomë këshillimi për marrjen e vendimit përfundimtar, të cilin do ta shpallë më datë 03.07.2025, ora 15:00.

    Seanca gjyqësore publike do të zhvillohet në ambientet e Kolegjit të Posaçëm të Apelimit, në adresën: Bulevardi “Dëshmorët e Kombit”, nr.3. Tiranë.
