The Special Appeal Chamber held on 22.01.2026, at 13:00, the public hearing of case (JR) no. 21/2024, dated 06.06.2024, pertaining to the appeal of the Public Commissioner against decision no. 743, dated 19.03.2024 of the Independent Qualification Commission, related to the assessee Gentian Hamiti.

The Head of the Special Prosecution Office, Mr. Klodjan Braho, stated that the assessee, upon the submission of the new evidence and arguments filed during the judicial proceedings at the Appeal Chamber, managed to prove the opposite of the appeal grounds for all three vetting criteria. Finally, the Head of the Special Prosecution Office requested the Appeal Chamber the upholding of  decision no. 743, dated 19.03.2024 of the Independent Qualification Commission.

The assessee Gentian Hamiti shared the same position with the Head of the Special Prosecution Office Mr. Klodjan Braho and requested the Chamber the upholding of the decision of the Independent Qualification Commission.

After hearing the final arguments of the parties, the trial panel decided to close the trial and withdrew to make and announce the final decision, as follows:

The trial panel of the Special Appeal Chamber, composed of judges, Ina Rama, presiding, Albana Shtylla, rapporteur, Mimoza Tasi, Rezarta Schuetz, Sokol Çomo, members, announced the decision on case no. 21/2024, dated 06.06.2024, pertaining to the appeal of the Public Commissioner against decision, no. 743, dated 19.03.2024 of the Independent Qualification Commission, related to the assessee Gentian Hamiti.

At the conclusion of the trial, the trial panel, pursuant to Article 4, paragraph 6 of Law no. 84/2016, “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, and Articles 451 (b) and 463 of the Civil Procedure Code, unanimously decided:

• Dismissing the review of case (JR) no. 21/2024, pertaining to the appeal of the Public Commissioner against decision no. 743, dated 19.03.2024 of the Independent Qualification Commission, related to the assessee Gentian Hamiti.

This decision is final and effective immediately.
